ATTORNEY FOR CONSPIRATORS ADMITS FRAUDS AT TERRE HAUTE
INDIANAPOLIS. April 2. Admlttint that there .was fraud and conspiracy In the ' last election in Terre Haute and condemning conditions which hare exiated there for yearn, former Judge Charles , Orblson . arguing In the Terre Haute election conspiracy ease for Dennis Shea, County flealer Walsh and Police Judge Smith, denied they had any part in the conaplraoy. He denied that any part of the slush fund reached Walsh, who was treasurer of the county committee, lie assailed former Police Chief Holler, former Assistant Chief Nugent, Jack Hines and Buster Clark, blaming them for the conspiracy. ; "How can you convict men' on . the testimony of a bunch of crooks, thieves and saloonkeepers," he asked defending his clients In particular. "The court has said in his Judgment there was a conspiracy, I say there was a conspiracy to corrupt and defraud voters and to get by fraudulent means what eould not be gotten otherwise, I say that this la so because M men confessed. They have confessed that they have conspired to undermine our government. "There is only one question to decide in this ease, Who were the conspirators T" - . Judge Orblson lauded Dailey for his
conduct of the case. Orblson also paid a tribute to Mrs. C. C. Stlmaon for her work at the polls in the tenderloin district. - After reminding the Jury that the government diligence in finding fraud might bring Into court Innocent men, he added: "I do not want you to understand that anything I may say may be a reflection on the men on trial. They are not guilty because they belong to a certain political order. Bet ter that 99 guilty escape than one innocent man be pronounced guilty. "You can not convict a man on the uncorroborated testimony of co-conspirators alone. Did you notice the alacrity with which these pelf-confessed criminals testified. I know that the district attorney held out no promises that they would be given a good recommendation, and yet nature is so constituted that when they brought the dagger, into these defendants they think the deeper they sink it the more mercy they might receive." Judge Orblson told the Jury that his clients must be considered separately. And that it was probable for two to be guilty and the other innocent. He insisted that some plan or scheme of conspiracy involving all the allged conspirators working together- must be proved. .

Mayor Bobbins hopes that those people who desire to have the city oil streets this year will file their petitions and guarantees with the board not later than -Monday afternoon, so there will' be enough on file by that time to Indicate to council that it would be justified In appropriating for an oiling equipment. The .board has flatly refused to having the street department do the again pursue the oiling policy adopted last year, providing for the letting of a 'public contract to oil streets
