Freak Questions Bother the Treasury Officials Who Should Know.

WASHINGTON,' Nov. 21. Col. W. K. Osborn, commissioner of internal revenue, and William G. McAdoo, secretary of the treasury, have their hands full these days Interpreting the regulations governing the collection of the Income tax. Not only were they "stumped" when congress authorized the collection of these duties and providing hat they issue regulations governing the collection of the tax, but they have been busy ever since amending these regulations, promulgating others and interpreting those already sent throughou the country. They, however, are not the only men inside the service of the treasury department or outside, for that matter, who have been puzzled by the new law. Secretary McAdoo himself eayB that he is not fully conversant with the situation, but "is pretty sure that lawyers, bankers and others who act in a fiduciary capacity have some idea as to what the Treasury Department means by the circulars that have been issued." From time to time, Mr. McAdoo cays, the regulations will be so amended as to make more certain the requirements which the government will insist upon, and until that time, he says, the matter must be "straightened ou" by experience. Country Is "Stumped". ' This naturally has caused thousands of inquiries from various sections of the country asking for opinions by treasury experts as to just what is meant regarding this section or that clause. Individuals, who have never heard "at the source of origin" before, are perplexed as to just what the phrase means. "Parity of notes," "physical date of incorporation," and like phrases that have from time to time appeared in the regulations, are all Greek literature to the uninitiated. In fact, from the nature of inquiries received, the uninitiated are not alone in their uncertainty, for prominent New York bankers, real estate operators and others have profesed their inability to understand the terms Used by the financial experts of the Treasury, and ask the Treasury department to help them out of a dilema. As far as practicable the treasury department will do this, unofficially because it is not the intention that It shall be prejudiced, if occasion should require that, it must go into court to defend or institute any legal proceedings incident to the collection o fthe tax. Some of the many inquiries that ore being received daily at the departmt concern the following: Who has to pay tax on alimony? Io burglars and grafters have to pay a tax and is it to be held as the source oof origin? Do owners of private dwellings living therein have to pay the tax? Do the real estate brokers hold the tax on houses rented for another? Why are the president, members of his cabinet and members of congress exempt from payment of tax, as far as their salaries are con-

i ury McAdoo has answered some of the questions. In regard to Jhe payment i of an alimony tax, the secretary does not seem to be particularly sensitive. ! It does not matter much whether the former husband or the former wife is j required to pay the tax. It was sugj gested that if the husband had to I pay the tax it might be used as a 1 reprisal on the wife. Under the I "source of origin" clause, however, ! the secretary says he believes the husband will be required to withj hold the tax, and that it must be deI ducted from the alimony installment . before it is paid.

The secretary refused to answer the freak inquiry concerning burglars and grafters. He couldn't quite figure

! out how the income of a burglar i could be held at the source, nor could he determine how the Unites States j government could collect the tax from 1 the burglar, unlegs he was caught in the, act of theft and the whole haul confiscated. Colonel Osborn. who hails from j North Carolina, does not think much of the brains of lawyers in New York, i Boston. Philadelphia and Chicago.
