ACCOMPLICE E Prosecutor Gilmore Believes Convicted Man Had Help in Crime. JURY TO INVESTIGATE Will Search For Stranger Witnesses Saw Digging in Garden. EATON', O, Nov. 11 Although Elwood Davis has been found guilty of first degree murder for the killing of Benjamin Franklin Bourne and is awaiting sentence to life imprisonment. Prosecutor Gilmore announced today that he would try to find an accomplice. Since Davis was arrested the officers have been convinced that he alone was not responsible for the crime. These suspicions were' substantiated during the giving of testimony, when two state witnesses testified that they baa seen another man with Davis digging in the garden at the Bourne home just about the time Bourne disappeared. Both stated that they failed to recognize the other man. but knew Davis. The witnesses were Elmer Baldwin and Stanley McDonald. McDonald was the first to find the grave. During the search for the body he recalled that he had seen the two men at work in the garden. The finding was made when he examined the ground where he had noted their labors in April of 1911. Molding these suspicions, attorneys for the state believed the prisoner might tell all he knew when the jury's verdict was returned. Contrary to expectations, Davis showed not the least emotion op unusual nervousness when the stillness of the court room was broken by the reading of the verdict. He shook hands with several members of the jury, smiling as he advanced to the box. An investigation will be made during the coming session of the grand Jury. Sentence upon Davis will be passed shortly by Common Pleas Judge Rising er.
