CURRY LEGAL FIGHT TO HIGHEST COURT besperate Attempt to Prevent Deportation of Harry Kendall Thaw.

(National! News Association) SHERBROOK, uebec, Aug. 21. The legal fight to prevent the deportation or extradition of Harry K. Thaw into New York state by Canada was carried to very felt of the dominion government by Attorney W. L. Shurtless, repreaentlng Thaw today. Shurtless left for the Canadian capitol to lay Thaw's case before the department of immigration. Mr. Shurtless said he would .make a direct appeal to Commissioner Scott of the department of immigration for the release of Thaw on the grounds that he is Illegally detained here. "We will ask British justice for Mr. Thaw," said Mr. Shurtless. "If he is to be sent out of the country, we contend that he should be deported at the point where he entered Canada and

not turned over to New York." Judge Globensky postponed the hearing of arguments on Thaw's .habeas corpus petition from 10 o'clock this morning until 2 o'clock this afternoon. Thaw's council intimated that (they would seek further delay until iMonday. They evidently wish to delay the rearrest of Thaw by the immigration officials which would likely follow his release on a habeas corpus "writ. Thaw's brother-in-law and sister and ;Mrs. George Carnegie spent over an hour with Thaw in jail today and their

"Marry looks well and we feel that his chances for liberty are good. The authorities are proceeding without hysteria and seem to weigh all facts from the single view point of justice." At noon Thaw's counsel assembled for consultation and Mr. and Mrs. Carnegie and Dr. Evans also were present.
