of the Union Natural Gas Corporation, appeared before the state public utilities commission yesterday afternoon t Indianapolis, and asked for a ruling the method of procedure for grantteg a franchise under the new public utilities law. The representatives of the gas company had promised to have a tentative draft of a franchise ready to present at the meeting of the board of public works this morning. When the attorneys for the company examined the Indiana law, however, they found it so complicated that it was thought best to ask the commission to rule on the legal procedure. The members of the" commission stated yesterday that as the commission was very much in doubt about the exact meaning of the new law, it could not give an official opinion on the subject off hand, and suggested that the company and the city proceed with negotiations until a satisfactory contract could be determined on. Following this, the representatives of the city could appear before the commission and show why the city should grant a franchise to another gas company in Richmond. Informal Encouragement. The members of the commission stated informally that in their opinion the city of Richmond would have no trouble in convincing the commission that there was need of a new company in Richmond. The possibility of securing natural gas at 40 cents, a considerable advantage to the citizens who are now paying a $1.10 rate for artificial gas, was admitted to be sufficient reason. Under the new public utilities law, a city has no right to grant a franchise to a utilities company to supply a service already furnished by another company holding a franchise or indeterminate permit in the same city, unless the commission decides such competition a public benefit. Krick and Palm left Indianapolis last night for Columbus, O., whre they will meet with the president of the company and prepare a tentative draft for a franchise. The company Jhas promised to have this completed ' and in the hands of the board not later
than Tuesday of next week. The Allegheny Gas company recently filed articles of incorporation with the secretary of state, and the attorneys for the company claim that Richmond will be served by this company, as it is the Indiana subsidiary of the Union Natural Gas corporation of Pennsylvania. Gus Condo, of Marion, is the attorney for this company as well as for the Central Indiana Gas company, which is now buying its gas from the West Virginia fields.
