After this a public hearing will be held at which any citizen will have the right to offer an objection to any of the provisions of the franchise. If there are no Berkrus objections the whole matter will be retired to council for ratification." The people of Richmond will watch with interest the proceedings of the Public Utility Commission which had its first hearing yesterday. The case that is now being considered is the merger of the Merchants Heat and Light Company and the Peoples Light and Heat Company, both of Indianapolis. The hearing is of special interest to Richmond because the first thing to Tie established by the commission is the question of valuation of the plant. The action which the commission will take in regard to fixing the valuation of the Indianapolis plants will determine the manner of fixing the valuation of the public service corporations of Richmond. Valuation, hereafter, will be the basis for determining rates. Chairman Duncan's Opinion. The opinion of Chairman Thomas Duncan of the Public Service Commission, on the manner of valuing public service plants was given yesterday when Charles McPherson, the attorney representing the two Indianapolis gas companies, maintained that the Wisconsin commission valued its rlants on the cost of reproducing plants new today. Mr. McPherson contended that the proper way to fix tie "present value" of a plant is to determine the cost of constructing a similar plant and he would add to the replacement value the amount of money lost in bringing up a business to a profitable basis, while Chairman Duncan insisted that the depreciation on a plant must be taken from the replacement value in ascertaining a plant's present value.

Mr. McPherson declared that his position was supported by the decisions of both the Wisconsin courts and Public Service Commission,' but this was disputed by Chairman Duncan. "The law is a joke if it is as you say it is," declared Chairman Duncan, Promises Further Study. Mr. Duncan said that he was almost certain that Mr. McPherson had placed a misconstruction on the law, and he promised to study again the Wisconsin law before the opening of today's session. Mr. McPherson suggested that Mr. Duncan, having strongly expressed his opinion, was not prepared to examine the law with an opea mind. Mr. Duncan replied that while he was almost certain that Mr. McPherson's idea of the law was erroneous he was prepared to interpret the law as he finds it. "Your judgment of this law, in my opinion, is warped by the interest you have in your client, and I believe that it will be found that you have misconstrued the meaning and intent of the law," said Mr. Duncan, addressing Mr. McPherson. The contention between the corporation lawyer and the Public Service Commission arose after the commission had spent some time in attempting to obtain estimates of what the depreciation had been on the properties. The corporations entered an objection to the commission considering depreciated value in fixing the present value of the plants. Question Involves Rate. Mr. McPherson's position was that the corporation is entitled to a rate that will yield, above operating expenses, a reasonable investment on the cost of replacement. Mr. Duncan, however, held that the value upon which a rate should be based was upon, the cost of replacing the property, less the depreciation.

Reddinghaus Fined. Joe Reddinghaus, who was arrested yesterday while suffering from delirium tremens was fined $1 and costs in police court this morning. Reddinghaus has been held by the police several times while on the verge of delirium tremens. He was sent to the county jail for 11 days. Pleaded Not Guilty. Although he admits drinking six glasses of whisky and several glasses of beer, John McCoy, an awining worker, pleaded not guilty to public intoxication in police court this morning. He was found guilty, however, of intoxication and was fined $1 and costs. Demurer is Filed. A demurer was filed by the Ohio Electric company this morning in the case which the company is the defendant and Howard Frame plaintiff. Frame alleges that aB a result of negligence on the part of the employes of the defendant he was thrown to the ground and permanently Injured while riding on a car owned by the company. The demurrer was filed on the ground that the complaint did not sufficiently allege the facts showing that the defendant negligently and wilfully performed any act which would entitle the plaintiff to recover damages. The matter was taken under consideration by the court. Girl Is Adopted. Lillian L. Latz, 17, was adopted by John W. and Lulu Spears. The mother of the child is living though the father is dead. The mother gave her consent to the adoption in court this morning.

to 38li degrees, according to the reading of the government thermometer at Earlham college. This is the lowest temperature at this season for 31 years, says W. E. Moore, who makes the observations. Farther back than that the bureau at Earlham has no record. Coal Man Happy. Late yesterday evening as the Coal Man saw the tell-tale black smoke beginning to rise from chimneys about town, he made frantic efforts to get in touch with the Weather Man to congratulate him on the sane manner in which he has been conducting the summer. But the Weather Man got wind of this and shifted his hammers to the bulb of the thermometer. The mercury has been' climbing slowly upward since. Little Damage to Fruit. So far the wind, rain and frost has had comparatively little or no effect upon the fruit crop according to Wayne county fruit growers. Walter Ratliff, of North West Fifth street, says that the only harm done by the light frost of Sunday and Monday nights was to cherries. The other fruit was not damaged. Joe Helms, of Boston Township, says that he has not noticed any damage resulting from the last two frosts. The strong wind which blew both' nights probably saved the fruit, he says. Damage to Wheat. Mr. Helms says that the blight seems to be doing considerable damage in his neighborhood. The wheat has been falling, apparently without cause. He says that he has been unable to find any flies or joint worms, but that much loss will result. The wheat is not filling out well this year.

That there are many wayward girls in Richmond is the statement of Captain H. H. Deuter, head of the local branch of the Salvation Army. One of his statements is that during his period of work in this city he has sent a number of these girls from this city to the Rescue homes in Cincinnati and Detroit. The problem which is interesting the Salvation Army officers now is how to persuade girls to remain in Rescue homes. Although there are twenty-seven Rescue homes in the United States, the matrons have succeeded in persuading but eighty per cent of the girls to stay. Twenty per cent leave the homes for various reasons, says Captain Deuter. Girls who have been sent to homes from Richmond have been assisted materially, the local officers state. "The women who are in charge of these homes are often discouraged,
but always keep in touch with the girls for three or four years," Captain
Deuter said. "In an indirect way they keep in touch with them forever. The girls are not bound in any way to stay in the home or to come into It. The Salvation Army always succeeds in getting work for the girls who remain, which is generally a period of six months. The women may succeed in getting a girl to stay after they have failed with her three or four times." Work for Girl. This society is known throughout the country as "Out of Love" organization. It has done great work for unfortunate girls. It has saved more than three hundred girls in two months and succeeded in procuring work for them. Captain Deuter says that girls whom he and the members of the local branch of the army have sent to homes have remained, and that work has been secured for them in offices snd stores.
