Gmc fr to L TRY 31 1 Murderer of White Says He Will Not Enter Plea of Guilty. (Palladium Special) NEW CASTLE, Ind., March 17. Clarence Parker, the youthful murderer of Irvin White whose dead body was found near the Y. M. C. A. building, in Richmond, will be tried on the charge of murder in the first degree, the trial to open ou ' the morning of Monday, March 31. Judge Jackson this afternoon instructed the county clerk to prepare a special venire of seventy-five names from which the trial jury will be selected. Parker stated this morning in the county jail that he had . at no time contemplated pleading guilty to anything. He indicated that his defense would be self defense. Parker has a signed petition addressed to Judge Jackson asking that the firm of Harlan and Hoelscher be appointed to defend him as a poor person. He expressed a desire to retain Henry U. Johneon, but the latter is understood to be confined to his home by sickness. Parker will be formally arranged on the murder charge this week. Prosecutor Reller of Wayne county conferred with Judge Jackson and Prosecutor Evans liere today. He also saw Parker at the jail in the afternoon: RELLER AT NEW CASTLE. Prosecuting Attorney Reller went to New Castle today to consult with Prosecutor Evans of Henry county who will assist in the prosecution of Clarence Parker, charged with murder in the first degree for killing Irvin White in the rear of the Y. M. C. A. building on the night of Feb. 1. The trial will be heard before Judge Jackson of Henry county, the case having been venued there from Wayne on a motion of the attorneys for the defendant who believed he could not get a fair trial in this county. The main witness in the ca6e will be Bert Parker who was with his brother on the night of the murder and who saw the crime committed from a point fifty yards distant. An appropriation of approximately $200 will be made by the Wayne county council to pay the attorneys who will defend Parker. Judge Fox announced today that he had recommended that Pauper Attorney Hoelscher be appointed by Judge Jackson to defend Parker. The pauper attorney is not compelled to act in cases where murder is charged or in cases outside the county. BOARD DECIDES TO BUY ANOTHER MULE Nimrod Johnson, superintendent of the Municipal Light plant asked the board of works this morning to purchase another mule for the use of the light plant as one of the mules is diseased. He stated that the work of the light employes is often delayed through the inability of the mule to help draw the light plant dray. Mayor Zimmerman. approved the purchase of a new animal. NJUNCTION GIVEN BY SUPREME COURT Against Enforcement of the Newspaper Publicity Law a Railway Decision. (National Nwa Association) WASHINGTON, March 17. The supreme court of the United States today tied the hands of Postmaster General Burleson in the enforcement of the newspaper publicity law by granting the temporary injunction asked for by the Journal of Commerce of New York City. RULES FOR RAILROADS. WASHINGTON, March 17. The supreme court ruled today that railroads may make extra charge for personal or sample baggage exceeding 45 Inches in length of not more than ,5 pounds of excess for each additional inch, and that baggage exceeding 72 inches in length may be refused by carriers. , The ruling will particularly effect traveling salesmen and theatrical people.

HOSPITAL CASE IS OPENED IN COURT Jury to Hear Condemnation Proceedings Against the Kempton Farm. The condemnation proceedings instituted by the trustees of Easthaven against the estate of John and Clara Kempton located 3V& miles northwest of the city was called for trial today. The greater part of the morning was taken up in securing a jury. I The property was appraised by iBenj. Price, M. C. Price of this city and John Nicholson of Hagerstown. The value was fixed at $170 per acre and there are 150 acres. Kempton remonstrated against the condemning of his property and ia fighting the suit. He does not want to J sell the property at any cost though j he believes the price offered him by the state is insufficient. The Jury will be asked to fix a fair and reasonable price on the land or what it would bring at market value according to attorneys for the state. There were thirty-eight witnesses called and some testified this afternoon as to the value of the land. Real ; estate men and farmers were called I in to testify as to the value of the land j There are at present 830 inmates at I institution. Of this number approxi mately 100 will be placed on the farm, according to Dr. S. E. Smith, superintendent. MAY SOLVE A ROBBERY (National News Association) NEW YORK, March 17. A woman may be instrumental in bringing about ; the capture of the cracksmen who I took more than a quarter of a million j dollars worth of gems and cash from j the "impregnable" vault in the pawnshop of Martin Simons and Son in the j biggest robbery in this city since the j looting of the Manhattan bank, 25 ' years ago. This woman, who lives I above the robbed pawnshop gave the j police a detailed description of two young men who emerged from the basement of the building Sunday morning carrying large packages done up in manila paper. After the men emerged, the woman said, a one-horse wagon drove up, the nen placed their packages in it and then drove away.
