The case of the state versus Jack Lewis, cnarrd with .-HmfnaJ assault, v.iH go to the jury this afternoon. Each sifje wan given one and one-half hours in which to um un aJl evidence and I.resent Its final arguments. The defense reated at 10 o'( lock this morning. Will Reller, special assistant prosecutor, opened the final argument for the state. He was followed by the two attorneys for the defense and Prosecutor Allen will close the state's argument. During the morning session when the state's attorneys cross examined defense witnesses, Lewis smiled at questions asked by the former. Once, becoming angry at. a question asked by Prosecutor Allen, the defendant interrupted but was quieted by his counsel. In rebuttal the prosecution recalled Edith Moon, the eleven-year-old girl whom it is alleged the actor assaulted. The prosecution did not call John Moon, the father, who made out the affidavit, or Clara Moon, the mother.

How Joseph Pons met hia death will probably never be known. In his verdict filed this afternoon In the county clerk's office, Coroner Pierce states that Pons either deliberately threw himsell under the rear trucks of the Ohio afid'fTlertric Interurban on -South Eighth street; that he accidentally slipped under the trucks, or that ht. had stooped to pick up something which he had dropped at tho side of the tracks and was struck by the car in such a manner as to throw him under it. On this subject the coroner says: "It is concluded that the said Joseph Pons met his death either from choice or as a result of an accident for which he alone was responsible. No blame can be attached to the railway employes as the car was practically at rest when the said Pons fell under or threw himself under the car and al-
