(National News Association) INDIANAPOLIS, Oct. 31. That Herbert Hocklns, indicted secretary of the International Ironworkers union, was Detective Burns' personal assistant in turning up the McNamara case and getting forty-five of his fellow union men indicted for dynamite conspiracy was the testimony today of J. A. G. Badorf, commissioner of the National Erectors' association, in federal court.

According to Badorf's testimony Hocking came to him and told him that he had given Detective Burns Information soon after the Los Angeles Times explosion in 1910, which subsequently led up to J. J. and J. B. McNamara and Ortie E. McManigal. Badorf said that Hockins told him that in the fall of 1911 he might confess and turn state's evidence. Badorf also testified that Hockins told him of going to the superintendent for the McClintlc, Marshall Construction company and telling him of a plant of nitroglycerine made by McManigal in an old cooper's shop in Rochester, Pa. Badorf said the superintendent confiscated the nitro and informed Burns of his conversation with Hockins and that Burns and Hockins were hitched up with each other from that time on and that Hockins gave Burns information about his fellow dynamiters, thus affording Burns the opportunity to "get the goods on" Hockins' associates. "This fellow Hockins has snitched on everybody, including himself," said District Attorney Miller. "He has double crossed every one In the case. Even while he was turning over to the government the correspondence against his fellow iron workers, he double crossed the government by keeping the correspondence of President Frank Ryan and did not come across with It until it was demanded of him."

Supreme Court Upholds His Ruling in Injunction. The judgment rendered by Judge Fox of the Wayne circuit court in the case of William H. Pickett versus William S. Clendenin, was sustained by Justico Lairy of the state supreme court yesterday when the appeal of Clendenin was heard. Pickett filed a complaint against Clendenin some time ago In the circuit court, alleging that the fertilizing plant of the defendant was a nuisance, demanding Injunction and damages. Damages to tho amount of $150 and an injunction was given. The case was appealed to the supreme court by the defendant and the following decision was given: "The statute makes all things "injurious to the health, or indecent, or offensive to the senses a nuisance and ,a complaint against a fertilizing plant, showing it made plaintiff's property almost uninhabitable was good, and simply to call attention to the averments of the complaint is sufficient to demonstrate the fallacy of appellant's contention that the complaint twas defective."

Deaths and Funerals. BARNARD Martha Barnard, widow of Paul Barnard, a former resident of Richmond, died at Wichita, Kansas, October the twenty-ninth in her ninety-sixth year. In a rough and tumble game in the High School gym last night, the juniors won from the sophomores by a score of 16 to 8. The score was tied until the latter part of the game when the juniors found their pace and doubled their score in a few minutes cf fast playing. The dignified seniors brought the freshies to a realization of their proper place in high school athletics by marching over them to the tunc of a 13 to 2 score. The game was slow and uninteresting throughout.
