This objection could be met by the use of meters, the expense of installing same to be borne by the con sumer having a fire line, and as such Bervice would affect a reduction in inBurance rates, such expense would not jbe inequitable to the consumer. "This company is ready to enter Into ja contract with the city on terms that are reasonable to both parties, but it feels that the specifications in the Items heretofore mentioned are suffici ently objectionable to justify it in not making a bid thereunder. "We trust therefore that your hon orable board will deem it advisable to make such changes in the specifi cations as will eliminate those fea tures that are seriously objectionable from a financial and operative stand point CampflaJd'a Objections. We already know from the denial of the city's right to make such assignment by the representatives of the present company that such a sale could only be enforced through the courts. Such a competitor would be fortunate indeed if all such litigation could be terminated and the plant secured within three yars. This would leave but two more years to make the necessary improvements and extensions and to enjoy the franchise and contract. More than this no company could finance a million dollar proposition like this upon a two, three or five year basis. Citizens Must Pay. "But this clause is just as much to the disadvantage of the citizens and tax payers of the city as it is to the contractor. The object of the city in getting these competitive bids is, or should be, to get the lowest water rate for the consumers and taxpayers of the city. The hydrant rental of the city is paid by the tax payers while the domestic and commercial service is paid by the individual consumer. With this clause in, the water rates for hydrant and domestic and commercial service will be based upon a five year contract instead of a twenty-five year contract and franchise. Hence the rates will be very much higher. All profits which the bidder will have to make and all risks he will have to take will be calculated on a five year term instead of a twenty-five year term and consequently will be very much higher. "Recently the city has attempted to forfeit the franchise of one of its public service corporations and has threatened to forfeit others. With the knowledge of the city's disposition in advance, Section 29 of the water works specifications is a dangerous menace to any successful bidder. This section gives the city the right to forfeit the franchise and contract of the water works company for any violation of its franchise.nakes the city the judge in its own case and does not give the water works company any right of appeal to the courts. Of course, we know that the city cannot prevent the water works company from enjoining the city from an unlawful exercise of that power, still the city may summarily attempt to execute Its own judgment and destroy the property of such company. No Intermediate Hydrants. "All Intermediate hydrants should be abolished and all hydrants be made paid hydrants. It would prevent all dispute between the city and company as to what n intermediate hydrant Is, and prevent either one of the parties trying to take advantage of the other. You would then have a correct basis of comparison as to the cost of fire hydrants here with other cities
A GIRARDINPICTURE Bought for Permanent Collection in Marion.
Frank Girardin, one of the leading j Richmond artists and known throughout the West, has just closed a successful art exhibition in the public art ! galleries .in Marion, Indiana, public library. Mr. Girardin's work has been much admired by the art-lovers and the eaucational element of that city and j much complimentary mention has been made in the Marion papers with reference to the exhibition as a whole and also to certain favorite pictures, especially the "Path Through the Woods," which has been purchased by the library board for the permanent collection. A leading publication of Marion says: The many Marion people who have : viewed the Girardin pictures in the art room of the Marion library will be delighted to learn that the picture, "Path Through the Woods," has been purchased by the library board and will be the latest addition to the art collection being made for the library. This picture hung on the north wall of the art room during the recent display and was more admired than any other picture. While the art exhibit was closed Wednesday, people have still been visiting the library and looking at the pictures. They will not be taken jdown for packing until Monday. Mr. and Mrs. Girardin will remain in Marion until Tuesday. Professor Massena has arranged for a jaunt with Mr. Girardin along Deer Creek, believing the artist will find many scenes there worthy the attention of the artist. The trip will be made with a view to Mr. Girardin returning next summer, should he find the time, to paint Grant county scenery. The educational value of the exhibit of Mr. Girardin has been unequaled by any other exhibit of pictures made here, the school children taking special interest and visiting the art room frequently. as it now is you cannot get a fair comparison without counting all hyI drants intermediate and paid and as certaining the average cost. "Section seventeen provides for certain tests. The city water works plant in its present condition is not capable of producing such tests and will not be capable of standing said tests until the plant is remodeled. If the tests were made now and the company be unable to produce the tests, as it cannot do, the city would be privileged to stop all hydrant rentals until the tests could be met which would be clearly unjust. "Section nineteen requires water works buildings to be constructed of brick, stone, or, re-Inforced concrete. This might compel a roof of said material, where slate, tile, metal, or, other non-combustible material would be better. The smoke stack is limited to j brick or reinforced concrete. "A fine of $25.00 per day for delay in making an rodinary extension is excessive. A two days fine would prob ably exceed all the water rental that i could be realized from such extension in a year. Fair Valuation. "If the water works company should be compelled to sell to the city, it should be at a fair valuation. The words 'without bonus or per cent added' should be stricken out. Said words are entirely useless and tend to con- : fuse and may be used to combat the jidea that the 'going concern' value I should be considered. The words 'at its fair value' covers everything. "Another serious objection to this section is that part which prohibits the water works company from issuing bonds in excess of $600,000 without the consent of the board of works and controller. This is a very arbitrary and Inconsistent provision. In a previous section of these specifications many important and expensive improvements and extensions are specified and required and in another section still the city is given the power to compel the water works company to make any number of extensions and fine the company $25.00 a day each if it fails to make them and yet by this provision the board of works and controller are given the arbitrary power of preventing the company from raising the money with which to make such improvements and extensions. No rational business man would want to place himself In such a position. "A new section should be added to the specifications authorizing the Board of Public Works to make modifications in Improvements specified in the interest of the city with the consent of the successful bidder. Without such provision, after the ordinance is approved by council, the board of works would not be authorized to make any changes however advantageous to the city they might be." His Belief. First M. E. Society Listens tO an Able Address. An Interesting and Instructive address on "Customs and Progress in China" was given last evening at the First M. E. church by the Rev. Ellis M. learner, associate secretary of the Y. M. C. A., before the Standard Bearers, a recently organized society embracing about forty of the young men and women of the church. Preceding the address about 150 members and friends participated in a Chinese feast. The opposite customs of the feast were most noticeable in the black table cloths, and they were most keenly felt by those uho attempted to eat soupy foods with chopsticks. The parlors were decorated with Chinese banners and the tables laid with dishes brought direct from that country by Dr. and Mrs. I). W. Stevenson who spent a number of years there.
