JUDGE DELIBERATES ON DARROWEVIDENCE Admissibility of Evidence of Socialist to Be Decided by Judge Hutton. (National News Association) LOS ANGELES, Cal., Aug. 8. The question of whether Rev. A. Cantrell, socialist lecturer, would be permitted

to testify as an impeaching witness for the prosecution in the Darrow trial against his former friend Job Harriman, was to be decided by Judge Hutton at the forenoon session today. Cantrell had testified before the grand jury that Harriman had said to him in San Luis Obispo the morning after ,the destruction of the Times building : that "the byos are on the job" and that he had known of plans to destroy the newspaper plant. The prosecution ' sought to present this evidence of ' Cantrell to impeach Harriman, who .had sworn he didn't make such statej ments, declaring Cantrell wah his bitIterest enemy and had sworn to put I him behind the bars. The defense had ; pleaded this was collateral evidence bearing on an Issue aside from the Darrow case. The court ruled in their favor, but subsequently withheld his ; final ruling until this morning after

citations of authorities by the state. The defense will call Bert Franklin to the stand to explain a receipt for five dollars given by hi mto Mayer, the purported "Mysterious stranger" for work done by him. Former Juror Leavitt, who retired from the Darrow jury because of illness, has been operated on at his home for appendicitis.

Senate Favors U. S. Registry for Foreign Built Ships I Owned by Americans.

j (National News Association) WASHINGTON, Aug. 8. John Sharp Williams of Mississippi, in the snnato, introduced an amendment to the Panama canal bill today admitting J to American registry, foreign built f ships engaged in the foreign trade, ! and owned by citibens of the LTnited States. The amendment was carried by the vote of 34 to 24. This amendment provides that all legal prohibitions upon American registry of foreign ships engaged only in foreign trade, are hereby repealed provided ! the ships are of exclusive American , ownership.

SANTO DOMINGO IS IN ACM REVOLT Washington Hears Alarming Report from the U. S. Minister to Haiti.

BULLETIN. PORT-AU-PRINCE, HAYTI. Aug. S. President Clncinnatus Le Conte, of Hayti was burned to death today when National Palace was consumed by flames following the explosion in a powder magazine adjoining.

(National News Association) WASHINGTON, Aug. 8. Alarming news of a widespread revolt in Santo Damingo was received by the state department today. Minister Furnisa at Port au Prince, Haiti, reported that Gajabon, on the frontier between Haiti and Santo Domingo, had been captured by the rebels after a battle lasting fourteen hours, in which the rebels are reported to have lost 300 men. Gajabon Is considered a point of vantage for the Invasion of either Haiti or San Domingo. It is feared here that the action may precipitate open war between Haiti and Santo Domingo, which has been threatening for some time. The custom house in Gajabon is in charge of an American, and there are many other Americans residing in that city and vicinity whose lives and property may be endangered.

REBELS CONCENTRATE ON SOUTHERN MEXICO Latest Plan of Rebel Chief Orozco. May Abandon Western Campaign.

(National News Association) EL PASO, Tex., Aug. 8. Oen. Orozco, the rebel commander in chief, may abandon his plan for a campaign in West Mexico and move southward from Jaurez. There are already 2,000 Insurgent soldiers at Huamada while others are being concentrated along the Mexican Central railway lines. The bulk of Gen. Huerta's federal force is stationed at Chihuahua where they have thrown up intrenchments and planted cannon to defend the city against attack. The rebels in Juarez are executing prisoners by the wholesale according to the story of a deserting artilleryman who crossed the Rio Grande. This Mexican said that men arrested as federal spies are being shot dally behind the adobe Cuartel. He also said the provisions and ammunition of the insurrectos are running very low.

LAKE STEAMER SUNK

(National News Association) MARQUETTE, Mich., Aug. 8. The steamers, James Gayley and Rensselaer collided forty miles east of Manitou island early this morning. The Gayley sank and the Rensselaer came into port today with four feet of water in her forward compartments. The passengers and crew of the Gayley were taken on by the Rensselaer before the former ship went to the bottom. The damage is estimated by the owners at $300,000.

The city attorney is drawing up legal papers for the instituting of several suits against owners of lots in the city where weeds are allowed to grow profusely. The names of the owners and the location of the properties were furnished by Dr. T. Henry Davis, city health officer, who started today that test cases would be made of a few lot owners who would not cut their weeds when ordered to do so by Dr. Davis or other city authorities. If the city wins its ixst suit every owner of weel-filled property in the city will be prosecuted, stated Dr. Davis.

When Big $1,000,000 Dam at Gallipolis Breaks. GALLIPOLIS, O.. Aug. 8. Damage estimated at J300.000 was done when the Ohio river dam No. 326 gave way early today. The structure, which cost more than $1,000,000 had just been completed. The concrete in the foundation WHShed away and with it came don a greu part of the structure, which was considered to be the most highly 2coderr.I7.cd type of engineering In movable dams. At least one year will be required to rebuild the structure.

At a meeting of the Park and Lake association yesterday the plans and specifications for the concrete dam which is to be built at North Seventeenth street were approved, and It was decided to advertise for bids. Sealed bids will be received up until August 20 at 2 p. m. The water color print of the new dam and the proposed concrete bridge, made by Engineer Mueller of New Castle will be put on exhibition In ' Nicholson's window today.

2 KILLEMOO HURT On Boston and New Haven Railway Wreck Today.

(National News Association) ' BOSTON, Aug. 8. Two persons were killed and 100 injured in a wreck on the New Haven railroad at South Boston today. The second coach from the locomotive caught fire and it was feared that several of the passengers might have been burned In the wreck. There were three coaches to the train. The dead were engineer Tull and Fireman Campbell.

A COURT VACATION

Judge Fox announced this morning that there would be no court the last two weeks of August as he expected to leave the city. It was thought for a while there would be no opportunity for a vacation between the April term and the October term because of the large number of cases on docket. Most of these have been settled in court or by compromise.
