58 DEAD AS ' RESULT OF A
STORM
(National News ABSociation) PITTSBURGH, Pa., July 25. The latest estimate of dead resulting from the big rain storm which yesterday swept over Pennsylvania and West Virginia, is 58, distributed as follows: In Western Pennsylvania, at Uniontown, 14; at Smock Mine, near Grindstone, Pa., 14; at Linn Mine, 12; tin West Virginia, at Wheeling 2; at Lexnont, 4 miners drowned. Six are reported drowned at New
Martinsville, and at Ellenwood, West Virginia, L. H. King, Mrs. L. H. King and child are reported drowned. The local railroads were given one of the most severe blows in years in yesterday's storm. From various points throughout Western Pennsylvania nd West Virginia reports kept coming in to local headquarters during the afternoon and night, telling of bridges being washed away, landslides obliterating tracks, washouts fed inundations. Vnlon town, Fa. was completely isolated by the tie-up of both the Pennsylvania and the B. & O. The smaller towns along the numerous branches of the railroads were similarly affected . The railroad bridge at Connellsville, west side, between Connellsville and Mount Braddock, was washed away.

On the Pittsburgh division the Turtle Creek branch was badly washed out and the Youghiiogheny branch was tied up between Irwin and Cowansburg, and the Alexandria branch was washed out north of Crabtree. The tracks of the B. & O. were washed out in many places on the division between Sharpsburg and Newcastle, and also on the Wheeling & Pittsburgh section.

CHICAGO, July 25. Former Senator Albert J. Beveridge will be temporary chairman of the Progressive national convention. This was announced today by Senator Joseph M. Dixon. The former senator from Indiana has accepted the position and will sound the keynote of the new movement. The sale of seats for the Progressive convention opened here today under the direction of the chairman and treasurer of the executive committee. The seats are offered at $20, $15 and $10, and will cover the entire convention, August 5, 6 and 7.

EARTHQUAKE CAUSES DEATH OF HUNDREDS LIMA, Peru, July 25. The village of Huanzabamba, near the City of Piura, In Northern Peru, Is reported to have totally disappeared as the result of the earthquake which yesterday 6hook Guayaqquil and badly damaged Plura. It Is feared that hundreds of inhabitants have perished.
The city of Richmond cannot be compelled to pay the City Light plant the sum of $56,758.87, which is due the Light plant for current supplied the various departments of the city since February, 1910. This is the
opinion of the city attorney and other legal authorities who have investigated the matter thoroughly. The law construed by the city attorney as bearing indirectly on the fight of the City Light plant for the sum alleged due the plant, is one which states that where the city is the owner of the water works plant, no payment shall tie made to the plant by the city, for all water used by the city in ordinary cases, such as water for parks, city buildings and fires. City Attorney Gardner states this law. if applied to the Light plant, would prevent the city from paying to the Light plant the sum said to be due. The report submitted to Superintendent Johnson by the expert accountants who made the examination of the books of the various city officers, will be submitted to State Chief of Accountants Dehority. Johnson will make a note of the facts mentioned hi the report, append a report of his own, and make suggestions covering the report. This is expected to be sent to the mayor in a short time, and it is believed he will ask that the city pay to the light plant the sum due. As explained by City Attorney Gardner, who has made a close study of this question, the city may pay to the light plant the sum alleged due, but is not compelled to do so. This seems to indicate that whatever the attitude
of the state examiners may be in he local situation, the city will not be obliged to pay this large sum to the plant. The plant is in an excellent financial condition, and is applying part of its profits to a fund for paying off the bonded indebtedness of 1144,000 when it falls due; a part for a fund to provide for accidents or breaks, and preparing to double its present capacity.
