' If council tonight fails to act favorably on the agreement between the cltr and the T. H. I. Extraction company, whereby the company la to remove Ita tracks from the Glen, legal action will be resorted to stated Mayor Zimmerman this morning. "These tracks have to come out of the Glen," ald Mayor Zimmerman. "The governor of the state said to me thoae tracks had no legal right to be In the Glen, and If they haven't then they will have to come out." Several of the councilmen have stated they do not agree with the compromise In one respect the clause which provides the city shall pay for reining the cut. The track removal question has been up many times, and the public generally seems to be willing to have tracka removed at almost any tost, so It is believed council will overlook this objectionable feature.

Heppe Frederick Heppe, aged 51 years, died Sunday morning at bis home, 1608 North E street. He is survived by his wife, Catherine Heppe. .The funeral will be held Tuesday morning at nine o'clock from the home. The body will be taken to liogansport Tuesday morning at eleven thirty o'clock for burial. Frienda may call any time. Mr. Heppe was the electrician for the Pennsylvania railroad at this point. NEWBY Mary E. Newby. aged 71 years, died this morning at three o'clock at her home, 2214 North E. afreet. The funeral will be held Wednesday morning with short services at the home. Rev. Thomas McNary of the Second Presbyterian church being In charge. Burial will be in the Boston cemetery. Friends may call at any time. The body will be taken to Boston where services will be held at the Methodist church at eleven o'clock.

"Absolutely dustless,': is the qualifying phrase in the contract between the city and William Lancaster for road oiling, which was approved by the board of works this morning. The contract given Lancaster, provides he may charge 4V4 cents per frontal foot for the first application and 2V cents per foot for the second application of "Prime White Road oil." In case the road is then not perfectly dustless. the citizens may have a third coat applied free of charge. He is under $2,000 bond, Clem Gaar named as surety. As soon as weather moderates Lancaster will secure streets to treat with oil. The prices to be charged are about the same as those of last year, when black oil was used.
