U. S. Supreme Court Refuses to Grant Stay in the Proceedings as Had Been Petitioned For.

United States. Those who face criminal proceedings tomorrow are: Louis F. Swift, president of Swift & Co.; Edward F. Swift, vice-president of Swift Sc. Co.; Edward Tilden, president of the National Packing Co.; J. Ogden Armour, president of Armour & Co.; Arthur Meeker, his general manager; Edward Morris, president of Morris & Co.; Francis A. Fowler, director of Swift & Co. ; Thomas J. Connors, Armour's superintendent and Louis Hyman, manager for Morris & Co. The trial will be of the greatest importance. It will not only determine whether or not the National Packing Co. Is an Illegal corporation controlling absolutely the price of meat in the United States but it will also determine whether or not the eight years Investigation and prosecution of the beef trust officials and the expenditures of vast sums from the public treasury has been in vain. At the office of the United States I District Attorney James II. Wilkerson, who Is in charge of the prosecution, It was stated today that the government had retained the services of 011kver H. Pagln, and Barton Corneau, 'both of the United States Department of Justice and widely known as '"trust busters." In addition to this
counsel District Attorney Wilkerson will be assisted by Elwood God man. The Packers' attorneys Include John
' 8. Miller, famous for his connection with the Standard Oil cases; George T. Buckingham and Levy Mayer. The presenting of testimony will take up a great deal of time, and it is expected that the case will not go to the jury 1 for weeks and perhaps months. History of the Case. Taken chronologically the fight has gone along in this wise: February 18, 1903, Judge Peter S. Grosscup, at the request of the federal authorities, Issued an injunction that
restrained the Chicago packers' from entering into a combination. This was the first move of the United States
against the Chicago men. The matter ran along with desultory legal firing on both sides after tbi3 for two years. Then in February of that year the department of justice began to gather evidence of the alleged existence of the beef trust. A special grand jury to hear the case against the packers, as government agents had completed it, was called in March, 1905. Indictments against four companies and sixteen individual packers were voted by the federal grand jury, July 1, 1905. In December the cases were called for trial and were postponed. In March, 1906, Judge Humphreys Bitting in the United States Circuit Court rendered a decision referred to since as the "Packers' immunity bath." The circumstances were these: Soon after the formation of the Department of Commerce and Labor and then Commissioner of Corporations, James Rudolph Garfield, began, not for prosecution, but for the use of the Department of Commerce and Labor, and investigation o fthe alleged beef trust. Information desired by the commissioner was given by the packers under promise by Garfield, that they would be immune from prosecution by
the government for any violation of the anti-trust laws as they might be revealed in the information. Judge Humphreys held that on this account the packers could not be called upon to answer the charges in the government indictment. Hence the "immunity bath."

In 1908 a new investigation was begun and dropped with no apparent reason. In 1909 still another investigation was begun in Chicago. In March, 1910, the federal grand jury returned an indictment against the National Packing Company and its subsidiary concerns. A bill in equity was filed asking that the National Packing Company be dissolved. U. S. Wins Hard Fight In June of the same year Judge Landis quashed the indictment. At this time a new grand jury investigation was ordered. The packers after a hard fight, were indicted September 12, 1910, and then began another long fight, to prevent the cases from coming to trial. Every legal expedient known to high trained corporation

They contended that the packers wer permitted by virtue of this "bath" to go ahead and form a combination although they did sot admit that this had been done and to do whatever thej liked with the fresh, meat business of the country. The con-, tentlon was new. The packers asked for the quashing of the indictments: In March of the present year Judge Carpenter rendered his decision refusing to quash the indictment and ordering the indicted packers to trial. The decision in the Standard Oil case afforded the packers some hope that the government might drop its case against the Chicago men. This hope was abandoned, however, and the packers' counsel sought a fur
ther delay by attacking the validity of the criminal section of the Sherman law.

exhaustively discussed by experts at the nineteenth National Irrigation Congress, which assembled in Chicago today for a four days' session. The activities of the congress originally were confined largely to the Western section of the United States, but in recent years the scope of the organization has been greatly broadened.
