CASE IS UP AGAIN MHBSSSM.SXas.MSM Widow Claims Husband Was Not a Suicide, but Accidentally Shot. ine case of Lrna C. Von Pein, of this city, widow of Kred Von Pein, who committed suicide here a few years ago, against the American Central Insurance company will be reopened at Martlndale next Friday. The case which was filed by the plaintiff In the attempt to force the company to pay to her $2,500 on a life insurance policy, was taken from the Wayne circuit court on a change of venue to the Marion Superior court and the Jury disagreed. It has now bocn decided to hear the case at Martlnsdale. A great deal of interest has been manifested In the case, on account of its singularity. In 1907 Kred Von Pein committed suicide by shooting himself at his home on South Eighth street. In 1905 he had taken out a life insurance policy which stipulated that In case of his natural death $2,500 was to be paid to his wife but in case of suicide within less than two years after he had taken the policy nothing was to be paid to his family. He committed suicide two days before he had held the policy two years. At the hearing in the Marion cir cult court Dr. A. L. Bramkamp, who was coroner at that time testified that Mrs. Von Pein had told him that her husband had shot himself as the re sult of despondency. She later claimed that her husband met his death as the result of accidental shooting and said that inasmuch as her husband had not taken his life that the money should be paid her. The jury disagreed In the caBe and it will now be heard at Martlnsdale. ASKS THE POLICE TO HELP LOCATE HORSE Owen Caskey reported to the police department on Friday afternoon that a horse belonging to him is missing from his farm four miles south of this city. When Caskey arose the horse was-gone. He believes it strayed away from the farm. HAS RETURNED HOME Mrs. Homer Hammond, wife of H. M. Hammond, president of the board of works, who has been seriously ill at Kokomo for the past few days where she had been visiting, returned to this city on Thursday evening. OFFICERS 4 GAVE TESTIMONY The injunction suit filed, by Henry Johanning ngainst (he South Side Improvement Association which opened in the Wayne circuit court on Thursday morning is still being heard by Judge Fox and It is likely that the case will not be finished until Saturday afternoon. Several witnesses testified on Friday, including officers of the association. The suit is an attempt to force the association to take down a high- board fence which It has erected around Beallvlew park, on South Eighth street. The plaintiff alleges that it has depreciated the value of his property, which is near the park and that the lots in Beallview addition were sold with the understanding that the park was to be public and not to be used for private pain. A GALLANT FIGHT Killed Eight Yaqui Indians, So His Brdther of This City Learns. J. W. RIdgeway, formerly of Wabash, but who recently purchased a restaurant at 428 Main street has just received word of the death of his brother, Oliver Perry RIdgeway, who was killed and Bcalped by Yaqui Indians during the early part of August. In the Assuji district, about 125 miles southeast of Phoenix, Ariz. The only details available concerning the tragedy are given In a letter received by his wife, Mrs. Rena RIdgeway, of Wabash, which was sent to her by two mining engineers who found the unfortunate man's body. Mrs. Margaret Hunt of this city was a sister to Ridgeway. The two engineers stated in the let ter that they found Ridgeway's body in a cave and on the outside of the cave they found the dead bodies of eight Yauqi Indians. Ridgeway had shot five out of eight of the Indians through the forehead. The front of the cave was spattered with balls. Ridgeway was the only man, it is presumed wtio had been living in the cave, he going to that part of the country, which is south of the United States line to locate a mine. All of the empty shells were from the Winchester rifle which was found by the dead man's side. Upon examination it was found that he had been shot twice. The next day the two engineers found the dead bodies of three Indians and one white man several miles from the cave. MRS. POPE RETURNS WITH HER HUSBAND Mrs. C. J. Pope, of Detroit, wife of the mi'n who was found wandering and acting in a strange manner in the east Pennsylvania yards Wednesday afternoon and who was taken to the city jail for confinement and afterwards removed to the Reid Memorial hospital, arrived in this city on Friday and will accompany her husband to their home in Detroit. It is said that overwork caused the strange ac tions of Pope. TAFT DEFENDS ACTS BEFORE INSURGENTS (National News Association) SALEM, Ore., Oct. 13.
