MRS. ZIMMERMAN DESIRES DIVORCE

Wife of the Mayor Today Filed Action, Charging She Was Abandoned. Dr. W. W. Zimmerman, serving hia third term an mayor of Richmond, was made defendant in u divorce action filed by Mrs. Cyrcne Zimmerman in the circuit court Wednesday afternoon. Abandonment is the allegation of the complainant. Twice the mayor of Kichmond was defeated in an attempt to never his marital relations, once in 1901 when Judge Fox of the circuit court refused his petition and again in 1!2 when tho judge of the Henry county circuit court to which the case was appealed on a change of venue, denlfd the petition. The complaint is not of a sensational nature und was not a surprise to the friends of the city's chief execu-

stated in the complaint, she wishes uch other relief as she may be entitled to under the facts and circumstances of the case. Tried in January. Likely the case will be tried early In January unless something unforewen arises. The mayor is summoned t0 court, on December 31. but as this ia during the holidays and Judpe Fox expects to be out of the city, it is improbable a trial will be held at this (his time. Henry IT. Johnson is a(torney for the petitioner. Mayor Zimmerman has not been served with ; summons in tho case and it is not j known who will represent him, but) likely either city attorney A. M. Gardner or attorney W. A. Bond. In light of the fact that Mayor Zimmerman has attempted before on two occasions to get a divorce it is not thought he will contest the case. It is averred in the complaint that they were married in Richmond September 24, 1878, and separated on January 20, 1897. The separation, the wife avers, is due to abandonment, characterized in the complaint as purposely and wrongfully. The complainant alleges that Mayor Zimmerman has refused to return and cohabit. Dr. Zimmerman has resided at Seventh and North A street for several years. Mrs. Zimmerman has been living with her daughter and son-in-law at 227 North Third street for a number of years. GATES OF COUNTY WERE jjWK OPEN Affidavits Against Twentyeight Fugitives Were Dismissed by Court.

Gates of the county were opened on Wednesday morning to several fugitives from justice, many ot whom were charged witli wife desertion, other with assault and battery and a few with embezzlement and other felonies, when prosecuting attorney Cnas. Ladd moved to dismiss 2S affadavits and his motion was sustained by the court. Several of Iho affadavits were filed as tar back as 1105 und the State's attorney says in his motion thai even if some of the accused were arrested, the evidence which could b; gathered now was of such a nature as to make conviction impossible, while in a few instances the death of the prosecuting witnesses makes prosecu tion impossible and in others the offenses have been outlawed due to the time which has elapsed since the fil ins of them. Affidavits dismissed and the charges are: James llarnet, public Indecency: Kdward W. Porter, perjury i:i a voluntary affadavit; Daniel K. Petro, P. Warner, issuing fraudulent check; John Jenkins, two charges of assault and battery; Ed Vore wife desertion: John Mullins, assault and battery; Joseph Evans, assault Aid battery; John Haker, wife desertion; Frank Hudson, wife desertion; Perry T. Carr, wife desertion; Samuel Perkins, assault and battery; Frank Hart, larceny, Albert Oosselin. embezzlement; Hoscoe llroadus, child desertion; Jolin W. Crawford of Connersville, colored, ailing assault and battery with criminal intent on Mabel Muey; and Ira Lewis, wife desertion. City Statistics Deaths and Funerals. Attorney Orange S. Harrison, until recently a minister in the Methodist church and who was retired on an annuity by the North Indiana M. E. conference a few years ago. represents Clara B. Campbell, a deserted stenographer, in a divorce action against Asher Campbell. The suit was filed la the circuit court on Wednesday and the Campbell woman alleges that for the past two years no provision ha.s been made for her by her husband and that he deserted her for no good cause on January 31, 1901. They were married on May 4, 192. Her maiden name was Clara B. Coole.
