Under the present law regulating the sale of eggs, the department feels

to be bad when he sold them in order to make a prosecution successful. Scores of prosecutions have been made under the law, but except in one instance all have failed, because the department was unable to prove that the seller knew the eggs to be bad when he sold them. The proposed amendment is to be aimed at the farmers rather than at

the wholesale and retail dealers. The. I

latter classes are supposed to test all eggs purchased and to reject the

bad ones, which they somewhat gen

erally do. But the fanner does no testing, with the result that the buyers find, according to the figures, an average og two bad eggs Jn every

dozen bought throughout the country. Since few dealers take the risk of being caught selling had eggs they are compelled to stand the loss of the two bad eggs, and prices quoted , to producers are usually made so that the dealer can throw out the bad eggs and still maks his profit. Buyers who know the producers in their territory and know them to sell only good eggs, sometimes pay higher prices to persons whose product they know to be good, but tttese are exceptional cases.
