PEOiIAGE FOUGHT BY GOVERNMENT An Alabama Case Will Be Brought Before Supreme Court This Week. A TELLING BLOW PLANNED
LABOR CONTRACT LAW OPPOSED, ; ALLEGING THAT IT REDUCES THE LABORERS TO THE CONDITION OF SLAVES. Washington, Oct 19. Believing that ' hundreds of southern negroes are being deprived of their liberty by big ' planters, under forms of law, the federal government will endeavor this week to induct the supreme court of the United States to strike a telling blow at the alleged evil. It will ask the court to declare unconstitutional the so-called Alabama labor contract law. Similar laws have been passed by several of the southern states, and the decision Is expected to apply to them all. . The treatment of negro farmhands under this law is Interpreted by the department of justice as a reduction of these laborers to a state of peonage. Compulsory service In satisfaction of debt is taken by Attorney ' General Wickersham as the object to I be accomplished by the legislation. : The state of Alabama will appear 'in court to defend its enactment. It is claimed by Attorney-General Gar ber of that state, that the law in question Is not aimed at the negro as 'a class, and, anyway, that this is a proper exercise of the police power of the state to stop fraudulent practices from which the south has suffered severely. The case cemes to court on the appeal of a negro, Alonso Bailey, from the decision of the supreme court of Alabama, which held the law constitutional and punished Bailey for violating It by assessing a fine equivalent to 136 days hard labor for the county. The Case In Detail. Bailey entered Into a contract to work as a farm hand for the Riverside company during the year 1908 for the sum of $12 per month, the contract reciting that Bailey had received $1B In advance and was to receive the balance due him at the rate of $10.75 per month. He worked - a month and a few days, and then quit, it is claimed, without Just cause. He had failed, the record alleges, to re fund the money advanced him. The- negro was arrested under the "labor contract law." This law pro vides that In contracts of service, en
tered into by a laborer with Intent to defraud, where money waa advanced, . the contract broken without Just cause and the money not refunded, the laborer should be guilty of a misdemeanor. An amendment to the law in 1903 providing that failure to perform the service and to refund the money
should be prima facie evidence of in tent to defraud. Attorneys for Bailey and the attor ney generals of the state and the fed era! government have filed briefs with the supreme court in the case in . ad vance of the oral argument expected this week. Wlekereham's Argument. Attorney General Wickersham lays stress particularly upon the argument that the natural and reasonable effect of the statute was not to stop fraud ulen practices, but to Impose compul aory services on negroes who made up he bulk of farm labor in the state, in satisfaction of debt. "If the statute la a bona fide at tempt to punish fraud," the govern ment asks, "Why limit it to the case where the debtor falls to perform the service or return the advance? What would be said of a statute which, while purporting to prevent theft provided that there should be no offense if the pioperty. were returned ?" In reply Attorney General Garber and his associates argue that on the face or the statute the clerk in the store is as much within the terms as the farm laborer, and that there is no discrimination in the statute as to race or color. "Indeed, the only possible field of operation of this suggestion, reads the state's brief, would be to engender a prejudice against the statute." The Federal Contention. ' Probably the argument chiefly re lied upon to defeat the statute is the one that the rules of evidence adopted by the statute under the law of Ala bama, work to condemn the accused without a hearing. The government contends that the "axiomatic and el ementary principle" of presumption of innocence in a criminal procedure la uppiuieq dt me statute oy a pre sumption of guilt. In answer the state says that Bailey has no right to complain because he never took the stand to rebute the presumption of his frsudulent intention. . The government, in turn, replies that t'ue laws of Alabama closed his mouth by declaring that he could not testify as to his uncommunicated IntentIt Is expected that .the oral arguments will be based on these conten- . tlons. Unconscious, his body rigid, his eyes wide open and the action of his heart and lungs perfectly normal, William Smith, twentysix years old. a butcher, of 2400 Patton street, has "been in the" German hospital four days suffering, the doctors think, from catalepsy. Smith was working as usual in - a butcher shop at Twenty-eighth and York streets, but one afternoon be said he was tired and threw himself at full length back of the counter. When he failed to get up after several hours, other employes tried to arouse him. They found his body rigid and at once sent for the police. Smith was taken to the German hospital, and the doctors say his condition has not changed since his admittance. He is fed through a tube and the physicians have exhausted every method to arouse him. Advices from Je rusalem are to the effect that recent excavationa on the summit of the Mount of Olives resulted in the dis covery of the remains of a Christian church dating from about the year of 330. The floor of the nave is still buried. That of the transept is entirely exposed. It is of mosaic and is perfectly preserved. There is a baptismal pool in the south transept. One tombstone haa been found bear ing the Inscription "Theodurus" in Greek letters, which is quite legible. In the chancel there are two seperate mosaic floors of different designs, one thirty Inches above the other. The floor ia conceded to be the floor of St. Helena's church, dating from 330 while the upper floor is a restoration by the crusaders. The site is taken to be that selected aa the spot fixed by the oldest tradition as the place where Christ taught the dlciples how to pray. A Woman's Tongue. THE APPOiriTMEHT Successor to Senator Doliiver Will Be Named by the Iowa Legislature. CLOSE FIGHT EXPECTED AS TO WHETHER A STANDPATTER OR A PROGRESSIVE IS ELECTED SEVERAL CANDI- " DATES ARE MENTIONED. Des Moines, 12..", Oct. 19. It !s probable that the successor of Senator Jonathan P. Doliiver will not be known until next January. At that time the man to fill the two years unexpired term will be elected by the state legislature. There seems to be little doubt today that Governor B. F. Carroll will re fuse to appoint the man vho will take J the place of the senior senator. Ther are several reasons why this will be the best course for the governor to take politically speaking. Carroll Is a candidate for re-election to office. If he undertakes to appoint a man he will have to choose a republican allied with one of the factions, and his friends believe it would be fatal to his own ambitions to do so. Moreover, Carroll has a senatorial ambition and his appointee would have to receive his moral support before the, legislature. On the other hand if the governor were to postpone the appointment until after election, his friends believe he would be under suspicion by both factions. He must therefore make an announcement that he will not appoint any one to nil the vacancy, either before or after elec tion. ' Campaign to Decide Question. This places the whole question of succession up to the legislative district campaigns. While no politician has undertaken to secure information on the subject, the impression prevails that the progressive republicans have a larger number of legislative nominees than have the standpatters, but both factions are well represented on the party ticket. There seems to be a general belief that Walter I. Smith, congressman from the Ninth district. will be settled upon by the standpat faction. Other standpatters who have been mentioned are ex-Gov. Frank D. Jackson, Geo. D. Perkins of the Sioux City Journal, ex-Congressman W. P. Hepburn of Clarinda, J. A. T. Hull and John F, Lftcey, and Gov. Carroll. The names of A. B. Funk of Spirit Lake, Harvey Ingham, editor of the Des Moines Register and Leader, H W. Byers, H. C. Wallace of Des Moines and ex-Gov. Wm.
