BEGS TO BE SENT TO THE PENITENTIARY BUT JUDCE CONVERSE GAVE HIM A TERM IN THE COUNTY LOCKUP. Alleging that he was tired of belns kept in solitary confinement and was willing to confess to anything and jro to the penitentiary if they would only release him from such unbearable Imprisonment. Samuel Thomas, colored, aged 22 years, broke dow.i and made a complete confession to Sergeant ilort Little yesterday afternoon, that be had gained access to Proffets restaurant on South Eighth street early Sunday morning, and stol en a. small bank containing 12.50 In change. At the request of Thomas that he be sentenced Immediately, a special session of the city court was called about 5 o'clock and the negro was fined S10 and costs to which a 30 day jail sentence was added by Judge Converse. It Is the first time in several years that a special session of court has been held. Told, a Pitiful Story. Although a charge of burglary might easily have been placed against Thomas, in view of the circumstances which surround the case, both Prosecuting Attorney Ladd and Judge Converse were inclined to be lenient and an affidavit charging larceny was filed. Thomas told a pitiful story In court which worked on the sympathy of the judge to such an extent that the sentence was made as . light aa possible. The negro declared that he had bad nothing to eat all day Saturday; was out of employment and needed money to buy food for himself and his two small . babies. . Jle declared that he was. formerly employed at Proffet's restaurant and knew that money, was kept there In a small bank. Entrance to. the building was obtained by means of a ladder to the roof and then via a trap door. The robbery was , discovered the same day and was Immediately reported to the police. Thomas was suspected' of the theft from the first. When the. . negro saw Patrolman. Vogelsong on the street Monday morning he started to "hot foot" It In the vicinity of the C, C. tt I depot but the big, policeman was also , there with the. sprint and caught Thomas just as he was In the act of hopping a freight train out of the city. Thomas stoutly maintained his innocence until yesterday afternoon when .the solitary confinement apparently got on Ills nerva. IfflljBgWTFinal settlement has beeiTinadw In the estate of Elmer E. McDIvitt, a well known business man. who was asphyxiated by gas at his home on South Twelfth street, three years ago. and approved by Judge Fox of the circuit court. - The report was made by Walter J. Doan, administrator, and he shows that the credits and charges balance. Both were $7,861.12.
