The switch is on a direct line with the block, declared McDonald, and the operator could sot help noticing that the switch was open when he gave the signal. Red Light Visible. McDonald stated that he did not see the operator throw the block while he was in the station, but that he Is positive such is the case ln view of the fact that on entering the depot be (McDonald) noticed that the red light was visible. He asserted that when the whistle of No. 18 blew, he ran to the window while the operator shouted that the switch was open. McDonald claims that he ran out. but did not have a lantern as claimed, and that he realized It fcas impossible to reach the switch In time, so he made no effort to do so. He stated that it was all over almost before he had left the station. He denies saying. "My Cod. I left the switch open." McDonald claims that his conscience is clear in the matter and that he win stay and fight It oat to the end.
