Anderson, Ind., Sept. 28. Another
rap at the Indiana local option law was taken in the circuit court, when
Attorney Phil O'Neil filed a motion to
quash the affidavit charging Fred J Wischmeyer with illegal voting.
Mr. Wischmeyer lives at Pendleton,
and was arrested on complaint of the
drys on election day charged with casting an illegal vote. The claim was made he had not lived long enough in Pendleton t gain a legal residence. Tha case is set for trial October 24, and will be beard at that time unless the court sustains the motion to quash the affidavit. The Question Raised. Interesting questions are raised in the motion to Quash the affidavit, the most interesting of which Is probably the one which set up the claim that the whole option eectlon was an ille
gal affair. It is allesed that if the charges made against Wischmeyer in the affidavit are true, they do not constttut a public offense In the sight of the law. An Illegal Election. The question of the constitutionality
of the option law is also raised and is
likely to be threshed out before the motion is disposed of. The broad
ground is assumed in defense of Wischmeyer that the option election was an illegal one held under a law that is clearly unconstitutional so it Is asserted and consequently any alleged technical violation of tbe laws governing Indiana elections would not apply to the option election. The issues raised by the motion to throw the Wischmeyer case out of court are interesting inasmuch as they bring up to the court in another form the question of the constitutionality of the local option law.
