ACTION BY COURT TODAY
RAILROAD COMPANY IS MAKING EVERY EFFORT TO SETTLE ALU CASES OUT OF COURT EMINENT DOMAIN. Opposition is being encountered by the Pennsylvania railroad in its attempt to secure a right-of-way through Wayne county for double tracking Its system. The condemnation proceed ings which have been instituted In the Wayne circuit court are being contested by the property owners. The railroad is endeavoring to obtain settlements out of court wherever possible. Two cases were dismissed in circuit court today. In these cases land owners named King and Drlschl were named as defendants. It is being urged by the attorney for one of the defendants the railroad la acting beyond Its authority in attempt ing condemnation proceedings. Tbe question of eminent domain is up for consideration and many fine legal points are involved. Objection has been entered to the complaint and ar gument on the points Involved has been set for hearing next Monday. A Difficult Point. ' Concerning the right or eminent domain it Is pointed out that the railroad company has a track through the the county. It Is provided with an outlet for its car service. But ' to build another track, or to be entitled to build an additional track is a point beyond that meant by the law concern. ing eminent domain. It is alleged the second track Is not a necessity. It la not needed to serve the majority, bat for the promotion of the business of the company. The allegation la made that a second track la not needed Co the extent an owner's property may be appropriated. Judge Tax was overcome by the heat Monday evening and was unable to be In court Tuesday morning at the time set for the hearing of the Wadeworth case to be resumed. The jury was given to understand the reason and It was presumed by the state the case would be taken up again as soon as the court regained his health. ' The allegation la advanced by Wadsworth's attorney that the ease was not regularly continued by the court. There waa no judge am tko bench at the time.
