Secretary Haas and Attorney Shiveley Discuss Interchange Case. . WILL PROCEED LEGALLY Secretary Haas of the Commercial club and Charles Shiveley, attorney for the organization, appeared before the railroad commission at Indianapo lis today and discussed the inter change switch project. Just at present the commission seems to be stalled by the refusal of the Pennsylvania lines to comply with the order of the commission. The proper ' kind- of ju dicial procedure was one of the subr jects discussed. The railroad has said it will fight any move, by the commission to enforce its order to the U. S. supreme court EXPECT A RECORD ' BREAKING NUMBER Judging from the number of registrations up. to noon today the enrollment of the summer term at Earlham college will greatly exceed that of last summer, which was the banner year. . The total number enrolled could not be learned, but it is understood to be near the 200 mark, and a large number are expected to register tomorrow or Thursday, according to letters received by President Kelly. Columbus, Ind., June 22. -Some time ago a brood of young chicks, the prop erty of Mrs. Andrew Faulconer, of this city sprang into prominence, and now they seem to thirst for newspaper mention, although they are regarded here as mollycoddles. The eggs which formed, the home of these chickens were deserted by an unnatural mother hen before hatching time. COUNCIL PASSES OVER MAYOR'S PROTEST ORDINANCE APPRO ; PRIATINQ $100 TO THE ART Af ' SOCIATION. : Council is wearying over the delay in enforcing the , peddlers' lieenu against the foreigners who are retailing ice cream cones in the city. At the meeting last evening Councilman Englebert Inquired why the city could" not follow Dayton's plan and fire these transients from the city. This la im poaaible. according: to Attorney Steady, and it 1 probable that aa tnvestlsattoai will be made to ascertain what the foreigners do with their unused cream, It is probable that they can be dealt with for selling impure food. The city fathers became entangled with the parliamentary rules in considering the Improvement of 8outh Eleventh street between C and B , streets, by the construction of cement sidewalks, curbs and gutters. This improvement had been successfully re monstrated against at a meeting of the board of - works and . recently. However the walks are so badly needed that the matter was referred to the the attention of council and an ordinance was presented last evening authorlaing the improvement. Bartel Changed Mind. A motion to suspend the rales and place the ordinance on passage was . killed by a negative vote of Council- ' man Bartel of the Fourth ward. Council soon afterward adjourned and it . was explained to Mr. Bartel that coun cil's approval was so evident that he . should withdraw his negative vote and vote for suspension of the rules. He attempted to do so but was declared Out of order. ' Mayor Schilllnger instructed Sergeant Little of the police force to call a special session at once, but City Attorney Study also ruled against this procedure, holding It illegal. The ordinance will therefore come up for final action at the next meeting. The ordinance passed two weeks .ago. appropriating f 100 to the Richmond . Art association, which Mayor Schilllnger refused to sign, was passed last evening by unanimous vote. The mayor"a failure to sign the ordinance practically amounted, to a veto. - r . . The committee on accounts and claims brought in an adverse report as to allowing William Decker's claim of $3.70 for damages to his fence which : was caused by the fire department running Into it several weeks ago. . Council sustained the action of the committee. ' " , Von Pein Complains. Complaint was made by Council-, man Von Pein as to the custom of removing old macadam from one street to another in order that the former street might be macadamised. He declared such was being done by removing old macadam from South Seventh street to High street. The bad condition of the South Seventh street park walks was also reported by Mr. Von ri in. Both - complain U- went to the board of works. Inquiry was made by J Councilman McMahan concerning: chuck, holes on Main street from the bridge to Eighth street The board has called the at-. tention of the proper corporations the water works company and the street car company to the necessity of Immediate action jon their, part. These corporations liPmaklng excavations failed to replace the pavement in aa good shape as they found it. Want Walk Made. Roy T., Cooper. F. A. Cooper, Walter L. Brooks and John E. Elliott through, Councilman Ogborn have petitioned for the construction of a six foot cement sidewalk - on North Twelfth street between 1 and J streets. The petition was referred to the board. Mr. Ogborn also had a number of complaints to make about the bad condition of streets and sidewalks la Riverdale. To the committee on franchises was referred the petition of twvatp-Cve property owners on Central avenue for tbe cbangf nar of the name of this street to College avenue. ' .
