Sudden Closing of the Case for The Defense Was Startling Action Arguments Heard On Monday.

New' York, May 8. John F. Mcln-

t yre, chief counsel for Captain Peter

Conover Hains, on trial at Flushing, for the killing of William E. Annis, at the Bayside Yacht Club, made the pos

itive assertion today that he felt nine of the jurors would vote for the acquittal of the army officer on the first bal-

ot.

I feel that the first ballot of the

ury will be nine for acquittal," said

Mr. Mclntyre in discussing the posi

tive outcome.

"I feel that a good majority of those

twelve men have made up their minds that Captain Hains should be acquit

ted. They have heard -the terrible!

story of the wrongs done him. I am not at all worried about the testimony aimed against him by bis brother

officers and the evidence of the alien

ists for the prosecution helped us instead of hurting us."

Made a Bold Move.

By suddenly closing the side of the

defense after the prosecution had fin

ished with its witnesses in rebuttal.

Mr. Mclntyre made his boldest move.

By bringing forth army officers and

alienists in rebuttal the prosecution

practically wiped out the insanity defense built up for Hains. Mr. Mcln

tyre, however, instead of trying to discredit these witnesses, let matters stand as they did and announcement

was made that he, too, had closed hie

side of the case.

Both sides have filed briefs with

Judge Garretson, containing " sugges

tions and requests for . the court'"!

charge, which will probably be made

on Tuesday. On Monday the prosecu

tion and defense will sum up, the de

fense taking three hours for its ad

dress. The judge's charge is expect

ed to be over by noon Tuesday, and the case will then go to the jury. Before

that night he may know his fate.

Mr. Mclntyre said he would not use

more than three hours to sum up on

Monday.

"I can tell the whole story in that

time," he said.. "And what would be

the use of prolonging it?"

MAKE EXPERIMENT

WiTHWAB DEVICE English Navy Perfecting a Wonderful Plan.

London. May 8. It was learned to

day that the English government has

just concluded a series of experiments

with an important invention of rear Admiral Sir Percy Scott by which one

man can aim and fire all the guns of

a warship. According to comment

in the English press today the inven

tion will revolutionize naval gunnery.

Gun laying by men in the barbettes is abolished, according to the plan, and perfect control is obtained by one man. Both aiming and! firing is done by electricity. Neither the war office nor the naval office will give any information concerning the invention.
