r.ght, and went to Governor Matthews a democrat, who vetoed it. But when his secretary, Myron D. King, started to the house with the veto it was only a few minutes before midnight on the last night of the session. The session ended at midnight. King was interfered with and there was a real riot in the state house., that night in the effort to keep King from reaching the house with the veto prior to adjournment. And the effort was successful. The session was adjourned sine die about a minute before King reached the speakers stand, and the veto failed. But it was found afterward that the enrolled act of the legislature never reached the secretary of "state's office, as is required by the constitution. Before an act of the legislature becomes a law the enrolled act must bo filed in the office of the secretary of state. The records in the office show that the law as it appears in the statute books was taken from a printed copy of the bill as it was introduced in the house and no one knows whether the bills passed that way or not. v " A Nice Question. Governor Marshall's contention, therefore, is that the .law as it now appears, , giving the board of three
state officials the power of making
the appointment is invalid. On the
other hand, Sims and Billheimer claim that since the law has been allowed to stand during all the years since 1S95, and has never be,en questioned, it is valid law. This raises a nice question, and everybody agrees that. It will never be settled until the courts finally pass on it. During the session of the legislature a few weeks ago, Governor Marshall madethe statement that he intended to appoint a man as custodian of the state house and that the appointee would be a man big enough to go in and take possession of. the office. Later, he proposed that the whole matter be left to a commission composed of one lawyer selected by himself, one selected by Sims and Billheimer and a third to be chosen by the first two lawyers, and whatever these three lawyers decided should be accepted by both sides. For a time it looked like this proposition would be accepted. The governor also proposed that the Question be submitted to the Appellate court judges or the supreme court judges and that their decision be accepted by both sides. Declined to Agree. Yesterday afternoon Sims and Billheimer called on the governor to discuss the matter. They declined to agree to either method of arbitration. They said such a decision would not
be a final adjudication of the matter, and that no matter which way the declsion went It would- have to be settled in the courts. Such a decision might settle the question this time, they said but the same trouble would be likely to come up again in future administrations. They best way, they said, was to have It settled now. once for an. When Sims and Billheimer left the office of the governor just before o'clock last evening it was with the understanding that they would appoint a man to the place and the governor would appoint a man. Then the courts will be asked to decide which appointee is entitled to the office. But It will be interesting to see which appointee gets possession at once. The present custodian is Otway A. Baker a republican and it Is to be expected that he will decline to turn his office over to any one appointed by the governor. So he will probably give the office to the man appointed by Sims and Billheimer. On the other hand the governor says he will appoint a man who will be big enough to take possession of the place and that he will call out the state troops if necessary to enable him to take office. This part of the scrap promises to be interesting
therefore.

State Billheimer on the other side
came to a real, final deadlock, yester
day evening, over the question of who
should make the appointment of the
custodian of the state house, and the
whole matter will have to be settled i by the courts. Governor Marshall will appoint Thomas F. Colbert, of this city, to the place and Sims and Bill
heimer, if they carry out the promises which W. J. Hastings, of Hammond says they made to him. will appoint Hastings. They will have to go into the courts and fight out the question of which appointee is legally entitled to hold the job. " Their Contentions. Governor Marshall insists that the right of making the appointment rests .with the governor, and that the governor has always made the appointments. And this is true.. On the other hand. Sims and Billheimer declare that the law giving the governor the right to make the appointment was repealed by the act of the legislature of 1895. which said that the custodian and the chief engineer of the state honse should be appointed by a board
consisting of the governor, the auditor
