In an effort to secure sufficient funds to erect their new church ,the members
of St. Mary's hcurch have been assessed according to their means. It is the Intention to , raise . the entire amount from subscriptions among the
members and not go outside of the
church. The list as published in the
Parish Monthly contains 633 names.
It every parishioner subscribes the amount asked, it will total more than $63,000. Up to date however, pledges
from the members amount to a little more than $27,000. No apprehension Is felt on the part of the parishioners
but that sufficient funds will be sub

asked. He has been requested to give $2,600. He Is the only person of whom so large an amount is asked. James Griffin is another member from whom a large sum Is asked. He is requested
to give $2,000. Other subscriptions asked range from $1,000 down to $20, there being but one member who is asked to contribute this amount. The

IGATION , WILL END. Counsel for the Starr Piano Com pany has accepted judgment on the de
murrer in the case of the Starr Piano Company against the city of Richmond and George Schneider, executor of the
will of John Schneider, the deceased contractor. This means the company
will not carry the case to the supreme
court and will pay the cfty the $1,200
due as the first assessment for the
construction of a storm sewer in
South First street. The company had
asked for an injunction against the
city, but the circuit sustained the de-i murrer to the complaint. Notice of appeal then was given. No Further Litigation. The company by paying its assess ment will avoid continued litigation through the higher courts. John F. Robbins, local counsel, said today he believes he would have a good chance to win a favorable verdict upon an appeal. However the company did not care for the litigation and expense, so chose to settle. Counsel for Schneider had secured the sustaining of the demurrer. Originally the company brought suit against the assessment of its share of the cost of the street improvement. The court held that the petition for a board of disinterested freeholders to act as a board and review the assessment was invalidated by reason of the unconstitutionality of the law. This case was dismissed following the court's rling, but the matter was to have been brought to a higher court's attention to test the constitutionality of the law. In its second suit the company held that if one section of the cities and towns law were unconstitu-
tonal, the entire act would be and con-
sequently the city could not collect the sewer assessment. The court held such an assumption did not follow necessarily.
