the meaning of the constitution. As it Is expected, however, that Mr. Root will quit the cabinet some time in January and on March 4 will fake the oath as a senator from New York, the matter may go over until Mr. Root be
comes a member of the senate and in ; such capacity Is confronted with the ! constitutional duty of passing on all treaties with foreign powers. This would afford him a spendid opportunity to reconcile his sworn duty as a
senator with his previous duty as secretary of state. Who Will Be Secretary? The question as to who shall succeed Mr. Root at thehead of the state department is still an entrancing theme of speculation at the capital. It generally is assumed that if Mr. Root quits the cabinet before March 4 President Roosevelt will appoint Robert Bacon, now assistant secretary of state to succeed him, but it is not at all likely Mr. Baco would continue in that -apacity under President Taft. The latest name to be mentioned In connection with the state portfolio is lohn C. Spooner, former senator from Visconsin, who left congress in order 0 recoupe his fortunes by the practice f law. He has hardly had time since, saving the senate to accomplish much 1 the way of mending his financial 'fairs, but the chance to serve at the ad of the cabinet might appeal to !m anyhow. Postmaster-General 'eyer has appeared at thehead of a eat many proposed cabinet slates, id other men mentioned for the preilership are Senator Henry Cabot
lodge of Massachusetts and Senator Philander C. Knox of Pennsylvania. Judge Taft Is still keeping bis own counsel.
LEGISLATORS ARE NOW DRIFTING ON SEA OF DOUBT (Continued From Page One.)
and the purpose of It, if it really is what it Is reported to be, proves that at the wind-up there will be just two camps In the senatorial fight, and they will be the Kern camp and the Slack camp. This, of course, unless something happens that does not now appear. To presume for an Instant that Steve Fleming would allow any support that he can control to go to Kern, especially if Taggart is behind him, is foolish. And whtn the time comes that Hofman, Shlvely, and Menzies find that they cannot win there will be a re-alignment of the forces. Menzies' strength will go to Slack, at least most of it. So will Hofman's. Lamb's votes will be divided between Kern and Slack, and the same will be true of Shively's votes. It 13 said that a combination has been made Detween Kern and Lamb so that the one that cannot win will throw his strength to the other, but this Is an idle rumor. No such combination is necessary. Everybody knows that Lamb will favor Kern if he can not win himself, and a combination such as this would be superfluous. Where is Shively. For some reason not much is heard about Shively here at the capital. Just why, is strange. He has considerable strength out in the state and will get a number of votes outside of his own district, but yet there is not much Shively

talk among the legislators who drift into this city. It may liven up for him later on, however, for all over, the state the democrats pin great faith to Shively. He Is counted one of the very strong men of the party. Today the republican senators are here for a conference. While, they have several matters on hand, the principal one relates "to the control of the senate when the session opens. The republicans are framing things up so as to throw the hook into Lieutenant Governor Hall, the affable democrat f rom. Rushville, who will preside over the senate. They propose to make all committee assignments themselves, as well as all appointments and distribute all the plunder. Hall will only be permitted to put the motion when a motion is made. Aside from that he will be merely ornamental; Another matter that is occupying the attention of the republican senators Is that of the. contest the defeated democratic candidates for state officers will make in the legislature against the republicans who were elected by small pluralities. A line of action is being laid out to be followed by the republicans In this contest, and they say they ill be fully prepared to meet anything the democrats may undertake to do. This promises to be one of the greatest fights of the session for both sides are making great preparations tor it. Congressman Lincoln Dixon, of the Fourth district, has taken a hand In the effort to get from the department of commerce and labor at Washington, the information regarding the alleged fraudulent naturalization of foreigners at Hammond, which was refused to Peter J. Lyons, the Hammond attorney, at New York. Dixon has asked Secretary Strauss to Instruct the commissioner of immigration at New York to give Lyons the desired information as to the dates on which these foreigners arrived in this country, but Strauss says he wishes to investigate a little and will give his decision later! Dixon is interested in the matter because he represents the defeated democratic candidates for state offices in their contest before the legislature, and the information regarding the voting of foreigners in Lake county is one of the strong points on which they will 'rely to sustain their case.
