The colonel (ailed upon Judge Converse and after imparting to the police court magistrate the story of the girl's life, secured clem ency for her and she was released summarily by the judge. The prosecuting attorney did not think with favor of such action on the part of Judge Converse and said so. He did not ask for a dismissal of the case, but was left without recourse by the action of the judge. "'It may not have been law. but it was common humanity." said Judge Converse, in explaining his attitude in the case. Argument, on th- demurrer in the case of the Terre Haute, Indianapolis fc Eastern Traction company vs the City of Richmond was completed in the federal court at Indianapolis this morning. The concluding argument for the city was made by Mr. Gavin, the Indianapolis attorney, who assisted the local city attorney. The traction company was represented by John W. Kern and Ferd Winter. In case Judge Anderson sustains the demurrer the case will he put. at issue and if otherwise the city will file an answer to the complaint. WELL KNOWN MAN DIED LAST NIGHT. Bernard Moorman III for Several Years. Bernard Moorman, aged 5-1, formerly a well known retail liquor dealer, died last night after an illness covering a period of several years. Because of peculiar circumstances it will be one year before owners of bonds on the proposed new gravel road in Washington township will be able to draw interest, although the interest is payable semi-annually. There will be no money in tho treasury to pay the interest at the expiration of the first six months is the reason it will not be paid. The contract for the road will be awarded Monday, April 6. The county auditor will prepare the bonds at once and the treasurer will offer them for sale at par value. They bear 4'j per cent interest. The bonds will have to bear the date of May 15, although they will be prepared previously to that time. The law requires that such bonds be Issued in May or November. As a consequence of this law there will be no money collected by the county as an assessment paid in until one year later. This accounts for the necessity of the bond owners having to await one year before drawing their interest. ANOTHER TROUBLE ON TOP OF HERBERT'S MftNY Wife Seeks Divorce From the Former Preacher. David Herbert, the man of many trials and tribulations, self inflicted, has had his cup of sadness filled to overflowing. The saucer, too, is full and David, who became a preaeher while an inmate of the county jail may now be forced to follow the profession. His wife has filed suit for divorce. Bridget Herbert alleges David has failed to provide for her and that he is an habitual drunkard.
