Judge Wm. C. Converse Hasj Handed Down Oral Opinion On Meat Ordinance.

ARGUMENT TO DEMURRER. I

EB.NUSBAUM

Richmond, as a municipality, has won the first round in the preliminj.ries that are lead up to the test of the validity of the ordinance passed by the council soicf time a?;o requiring that a.11 meat sold on the Richmond market be federal Inspected. Following the arrest of C. L. Hunt, a prominent gruteryman. lor violating the ordinance, hi.s attorney. Wilfred Jessun. filed a plea in abatement, alleging that because of the failure of Mayor Richard Schillinger to .sign his name to the ordinance after it had been placed in the ordinance book, in 1) is own handwriting, it was invalid. After hearing the arguments on this by Mr. Jessup and by City Attorney

Thomas J. Study, Judge William C. i Converse took the case under advise- ; ment, withholding hi. opinion until ; this morninig. .Judge Converse, handed down an oral ; opinion yesterday ruling the plea in ' abatement, thus placing the ordinance i before the courts on its merits as it pertains to the regulation of the (sale of inspected and uninspected meat. ! Attorney Jessup has filed a demurrer to the complaint alleging that the ordii nance is unconstitutional and argni ment on the demurrer probably will be I heard on Wednesday. The city offi- . cials are well pleased with the progress they are making toward proving

tho ordinance a legal one.

the American ambassador. j . The baron has filled the post of Jap- j

enese minister to Italy. Among those attending the dinner was Foreign Minister Tittoni. Speaking of his new post. Baron Takahira said that in returning to the United States he felt as though he was going home, as he was at one time minister of his Government at Washington. He re

marked that, the dinner of last night i

was a forerunner ot ine traditional hostility of the United States.

GREAT BANDMASTER

John Phillip Sousa Who Will Be Here Will Give Musical Event of Season.

DOES MOT ASPIRE TO NOISE

Evansville, Intl., Feb. 4. The Evansville School board has decided that

jin the future no teacher will be eni-j

i ployed to teach in the city schools

who is unable to pass a most rigid physical and medical examination. This order grows out of the fact that there are now several teachers in the local schools who are suffering front consumption. They were employed before the present school board went into office and the members of the board do not see how they can break the city's contract with the teachers. The afflicted teachers will not be employed when their contracts expire and the board will see to it that hereafter only tho physically strong will be given positions in the school.

INCREASE OF RATES AFFECTS COMPANY

Loss of Business, But There Is Always Long Waiting List.

John Philip Sousa, the celebrated bund master and composer, will appear in the Coliseum, Monday evening, FeJj. K. and judging from present indications it will be one of the chief music- ! al events of the season. In an incredibly short time Sousa litis attained to the peer of band directors, a position which the musical world is fast appreciating. Sousas band is not one of those aggregations that aspires to "noise." on the contrary it is the most thoroughly artistic congress of band musicians on the American continent. . Artistic but not classical, Sousa is al-! ways sprightly, virile, full of life and energy. It is safe to say that all who have heard him will want to hear him again, while those who hear him for j the first time will be so enthusias-j tic as to find it difficult to suppress a j desire to throw their hate into the j

air and cry "Three cheers for Sousa!" This season has been one of the most successful in the fifteen years' history of the organization. Everywhere, they have appeared, hundreds are turned away from the doors and the S. R. O. sign tells the tale.

Story of a Stuffed Cat In

Smithsonian Institution. In the Smithsonian institution at Washington is a case containing a Btuffed cat A card attached to the case, setting forth the reasons why this particular feline is known to fame, gives ofliclal sanction to a tale that is in every respect as' remarkable as any emanating from the nature fakirs. The story of the cat is as follows: Many years ago, while the Washing

ton monument was still in an untia- J ished condition, an adventurous and patriotic cat ascended the interior of j the shaft by means of tho ropes and j scaffolding. When the workmen ar- j rived at the upper landing the next morning and began to prepare for the day's work the cat took fright and, . springing to the outer edge, took the : leap of over f00 feet to the hard earth ! below. 111 the descent, which was watched ' closely by the workmen, the cat spread j herself out like a flying squirrel, fell

t slowly and alighted, as cats always do, i on all fours. After turning over on the ! soil a few times as If dazed she pre- ', j pared to leave the grounds. She had j proceeded almost beyond the shadow 1 of the monument when a stray terrier j j pounced upon and killed her. j I One of the workmen rescued the rej mains of the cat and turned them over ' to the Smithsonian Institution, which caused the skin to be mounted and

Tha Way They Are Deflected by Atmospheric Causes. One of Uncle Sam's scientists at Washington gives an interesting ex

planation of the action of the wind in ! preventing the spread of sound toward the direction from which the wind comes. It is, he claims, not the wind, 8S

I such, that prevents sound from trav

eling against it. but differences in the strength of tho wind. If. for Instance, the wind is stronger above than below or stronger t one tide. Its effect will 1 to Til: the sound waves in one direction or another. Iuft'erenees c.f temperature in the ah also cause deflection of the waves of sound. Other atmospheric causes exist which deCect sound from a straight course aud prevent it from golns as far in cerTftin directions as It may have teen expected to go. j Some of the sirens iu this country, says the scientist, produce sounds which ought theoretically to be audible at a list.ince of 1.50O miles, but, in fact, the authorities are satisfied If. they are heard only two miles away, j The reason .for the discrepancy be-; tween calculation and experiment was j probably atmospheric deflection of the ! sound.
