Colonel Durbin practically gave the lie to Brooks by saying that If the Interview purporting to ccmo from him is correct, that he has wilfully made malicious and false statements. He declared that he has not talked with Crawford Fairbanks for several months and that there was no deal between blm and McCullough so far as he knows or was concerned. Waiting for His Second Trial in Dread, as Loved Ones Will Be Separated From Him
Second Hearing of Famous Case Will Begin Monday Morning When Jurors Will Be Exam inedEvelyn fo Tell the Sad Story of Her Anguish and Ruin. New York, Jan. 4. Harry K. Thaw is in dread of his second trial for slay ing Stanford Unite, because he will bo without the cheering presence of his loyal wifo and devoted mother an ho sits in the court room and because his favorite sister, the Countess of Yarmouth, will not come to this country for the trial. Under the new arrangement of tho courtroom the wife and the mother will be kept VZ feet away from the de fendant. At his first trial they were constantly with him and their love and words of hope did much to cheer him ! during his ordeal. Both of Mipra nH. oners were allowed to go free under a suspended sentence, after the two Juries had failed to convict them. Much New Testimony. The defense will offer much new tesimony testimony that was not brought out at the first trial. There will be a scoro of new eyewitnesses to the shooting of White, and r 1 will testify, that in their opinion Thaw was insane on the night of the murder. Mrs. Evelyn Thaw will again, in moulton words of anguish, tell of her ruin at the hands of the arch betrayer, Stanford White. Mr. Littleton has a list of the three hundred talesmen who have been summoned to appear Monday, Tuesday and Wednesday in the criminal branch of ho supreme court and detectives are investigating the record of each. This is done in every important murder case by the defense as well as by the district attorney. Mr. CKRellly and Mr. Peabodv called at the Tombs early yesterday to see Thaw. Thev consulted with him in the counsel room on the 6econd tier f tho Tombs prison. Thaw was glad o see Mr. O'Reilly aisain. Th Lin er has just recovered from an attack f bronchitis. Mr. O'Keilly said that he was feeling well and that outdoor exercise would soon restore him to his former self. The rumor that Mrs. Kvelyn Thaw had quarreled with her husband wa6 denied. Mrs. Thaw has been suffering from a severe cold, but she hRs been in dally communication with her husband. She last saw him Sunday. Evelyn Did Not Call. Mrs. Thaw's chauffeur went to the prison yesterday morning with a note that Mr6. Thaw would call later in the afternoon. But she did not. She is still a sufferer from a cold, it was said.
