bors, done much for his race. Bishop Smith is a scholar and has traveled extensively m this country, Africa, South America, the West Indies and Canada, obtaining material for his lectures on the race problem. A good sized crown neard his able address. A good part of the audience was composed of white people. Every one was impressed with the arguments made by the bishop. The title of Bishop Smith's lecture was "The Conflict Between John and Tom." In this lecture John represented the white man, while Tom represented the colored man. The bishop said that the white man had set the example in crime and that his negro brother had followed it. "There have been many white men hung in this country for committing crimes against society, while impersonating themselves as colored men," said the bishop. He stated that the conflict between the white and colored races in this country was caused because there was something defective in American civi ilization. Bishop Smith cited the fact ' that in Africa, South America and the i West Indies, where the negroes greatly outnumber the whites, it is almost an unheard of thing for a colored man to commit a crime against a white woman. At the close of the civil war. Bishop Smith said, there as on an average only one negro in teii thousand who was educated. Today, he stated, the average was one uneducated negro in ten thousand. This average, the bishop stated, included those who were formerly slaves. From these figures Bishop Smith brought out the point that the American negro is quick to learn and imitate. WIFE SHOULD RISE ANDJBUILD FIRES Judge Says Spouse Has Right To Growl. MARITAL RELATIONS JARRED Kokomo, Ind., Dec. 20 In the case against Bert Spurgeon for wife beat- ' ing, tried in the city court today, Spurgeon being acquitted, Judge R M. Cooper held that it was the vested right of a husband to growl at his wife at 4 o'clock on a wintry morning for not arising to build a fire in the kit- , chen range. I ! As the evidence in support of Spur- j ! geon was not especially strong, nor ; that of Mrs. Spurgeon as to the speci-1 fication charging wife beating. Judge ' Cooper recommended that where a . man was working in these times the wife should not be re!'.ctant to rise and prepare his breakfast, although it was at the early hour of 4 o'clock. The quarrel between the man and wife seemed to have been over the fact that she was compelled to arise early and build the kitchen fire for Spurgeon's breakfast. HAS CHILDREN TO SUPPORT; Ml IS GIVEN FINE

Roy McCutcheon Was Caught Riding Bicycle on Sidewalk And Was Corralled by Chief Of Police Bailey. FINE WAS REMITTED AFTER CONFERENCE. It Was Learned That Young Fellow Needs Every Cent to Protect His Hearth Stone During the Winter. Out of a job for some time, with a wife and children to support, $1.03 in his pocket and no coal at his home, Roy McCutcheon, a young man who recently moved here with his family, was arrested this morning by Chief Bailey for riding a bicycle on a side walk on West Third street. McCutcheon was prosecuted by City Attorney T. J. Study and fined $1 and costs, amounting to ?0, by Judge Converse. A short time afterwards Judge converse remitted the fine. The young man is not familiar with police court practice. He thought tnat his fine would only amount to $1. Waking up to the court he remarked, "Only a dollar?" and then thrust his hand into his pocket to produce the last "cart wheel" he had to his name. The court took McCutcheon's remark for impertinence and told him that if a dollar was not enough he would fine him more. McCutcheon apologized and stated that he had no Intention to become impudent. He then informed the court of his straitened circumstances. Judge Converse called McCutcheon into his private office and after a heart to heart talk the young man's fine was remitted and he was allowed to go. McCutcheon has just secured a job and lost no time in jumping on his bicycle and hurrying to his work, sidewalks being avoided. Chief Bailey says that he regards the practice of riding bicycles on sidewalks as a most dangerous one and that every time he sees a man violating the ordinance which covers this offense he will arrest im. The chief states that he does not arrest children for violating the ordinance. He makes them dismount from their wheels and receive a lecture on the evils of riding bicycles on sidewalks. Emley, of New York. It was disclosed in the testimony of Mrs. Emley, her sister, Mrs. Martha Hay den, and her mother, Mrs. Caroline Hoyt, that one of the grave causes of domestic conflict in the Emley household was the husband's habit of serving those at table with him with his own knife and fork. Mrs. Hayden testified: "One night at the dinner table Mrs. Emley took her husband severely to task for serving me with his own knife and fork. He became angry and made a scene right at the table. He told my sister she was crazy and didn't have the sense of a barnyard fowl." 4
