REPUBLICANS WERE DISCRIMINATED AGAINST IN SECURING THE VENIRE JAMES HOWARD WILL APPEAR AS WITNESS.

Georgetown, K, Nov. 21. After ; fighting for nearly a week, Caleb Powers proved conclusively that Sheriff Eugene Gregg and his Harrison county deputies had discriminated between republicans and democrats in summoning a special venira of 200 : men from which to select a jury to try Powers for the Goebel murder and Judge Morris ordered thai the 100 men of the venire yet to be examined be dismissed and a nw venire of 200 men be summoned from Grant, county. ! This is the greatest victory yet, won ; by the Powers defense in any of his : trials. By a large number of witness- ' s It was shown that Gregg had re- j pcatedly ignored republicans in favor of democrats in summoning the venire and that out. of the 210 men secured in Harrison county ISO were democrats, 24 republicans and 6 prohibitionists. Gregg, it was shown, had repeatedly spoken against Powers and had cursed .him. Gregg was put on the stand and made admissions most damaging to his side. Then, without hearing the arguments of the commonwealth, Judge Morris ordered that the 100 men awaiting examination be dismissed. Judge Morris' announcement order-1

lng a new venire created consternation in the prosecution ranks. It was learned that James Howard, who Is now serving a life sentence for the actual murder of Goebel, will be a defense witneR3. Howard, as was Powers, was convicted mainly on the evidence of Henry E. Youtsey, who is also serving a life sentence. Youtsey confessed on the -witness stand that after he had been given the key of Powers' office by Powers lie admitted James Howard to the room, gave Howard a rifle and Howard shot Goebel. Howard will deny this and will give evidence said to be very strong in favor of the defense. Youtsey lias prepared a petition asking Governor Beckham for a pardon.

Odd Fellows from every quarter of Indiana are in the city to attend the sessions of the grand lodge, but the ceremony which they are even more Interested in is the laying of the corner stone of what will be one of the mose modern structures in Indiana.
