Attorney General of Indiana Brings Action Against a Former Local Man. Reported That Several Citizens Have Their Eyes on This County Job. NOT ENTIRELY GIVEN UP.
FEES ARE INVOLVED IN IT.
TWO OTHER FORMER CLERKS OF THE INDIANA SUPREME COURT ARE ALSO INCLUDED NATURE OF THE ACTION.
Suit was filod Thursday by James
Bingham, attorney general for the Elate of Indiana, againKt Andrew M.
Sweeney, William T. Noble and Alex
ander Hess, former clerks of the Supreme Court, asking judgment for fees collected, ko it is charged, and illegally retained by Sweeney, Hess and Noble. Noble was cleric of the Supreme Court from November, 1S6, to November, 18&0, when Sweeney was elected and served four years. During Noble's term of office, it. is charged he collected a total of transcription fees and sheriff's fees of $,279.:10. By law, the attorney general states, the state is entitled to recover this principal with f. per cent interest from Nov. 22, 1SJ0, to date of judgment, and 25 per cent, of the principal, or $of5.8C, as a penalty. Noble was formerly a resident of Richmond. The charges against Sweeney are similar. Simultaneous with the filing of these suits in the Marion Superior Court, against Sweeney and Noble, Attorney General Bingham filed suit against Alexander Hess in the Circuit Court at Wabash to collect $3,552.24 in fees alleged to be due the state from him. Attorney General Bingham also contemplated suit against, the estate of Simon P. Sheerin. who-.a term as clerk of the Supremo and Appellate Courts expired in November, 18S'i, but found that Mr. Sheerin is dead, that Ills estate has been stalled anJ that the statute of limitation bars a suit to recover the money. "Each of these clerks became guilty of a felony by his failure to account for these funds, and by converting them to his own use at the expiration of his term," said Mr. Bingham, "but the statute of limitation runs against such crimes in two years from the date of their commission, and the time has long since passed when these men can be prosecuted criminally for such offenses. "These men have been honored by the people, and I think it is only fair to the public that it should know and that the peoplpe in the communities
In which they live should know what their attitude is with reference to these funds collected by them in their official capacity and which they now refuse to pay over for the use and benefit of the persons to whom they belong."

Romance of a Great Painting. No picture perhaps has bad so romantic an adventure or so miraculous an escape as Hapiiael's "Christ Bearing the Cross." It was ordered by the fraternity of Mouut Olivet at Palermo, the brothers wishing to have a specimen of the celebrated Italian painter's work bangiug in their monastery. The picture is remarkable for the truth with which the painter has portrayed the suffering of the Saviour as he bends beneath the heavy load. Raphael painted it in Home, where he carried out so much of his work, and the picture was carefully packed and dispatched by sea to Sicily. During the short voyage a storm arose, and the wind and naves became so violent that the vessel was wrecked. The crew and pas eugers perished, and no trace of the ship or her cargo was seen again, save the picture, which, floating in Its case on the water, was washed ashore and discovered by the expectant monks. On the case being opened it was found that the sea water had In no way injured the divine beauty of the painting, which was hung nii at Palermo amid great rejoicing and thanksgiving at its miraculous escape. -London Standard.

Then wigs and cowns appear. They tell you with happy faces their committees have adjourned, and then come a third class, the gentlemen of the press, hilarious. Why, what's the matter? Matter! Macaulay is up. You join the runuers lu. a moment. It was an announcement one hadn't heard for years, and the passing of the word "Macaulay's up" emptied committee rooms now as before It emptied clubs; the old voice, the old manners and the old style glorious speaking; well prepared, carefully elaborated, confessedly essay ish, but spoken with perfect art and consummate management, the grand conversation of a man of the world confiding his learning and his recollections and his logic to a party of gentlemen and Just raising his voice enough to be beard through the room. As the house filled he got prouder and more oratorical, and theu he poured out his speech with rapidity, increasing after every sentence, till it became a torrent of the richest words, carrying his hearers with him into enthusiasm and yet not leaving them time to cheer. The great orator was trembling when he snt down. The excitement, of a triumph overcame him, and he had scarcely the self possession to acknowledge the eager praises which were offered by the ministers and other! In his neighborhood. The history of horses, especially of thoroughbreds. gfs to prove that parts of Ireland and Australia are the very best cradles for horse breeding in
either Europe or elsewhere, with Kng- j land as the secord best, perhaps the ; equal. The suggestion has been thrown j out that the secret lies in a lime sub- j soil. The reason for the supposition ' is a little obscure. The present writer ba3 found that partridges bred on such soil are heavier and stronger and. it1 seems, fly faster than others, but this Is hardly an ami logy that can be ap- i plied to the horse. There are other curious analogies. It has long been noticed that the best high Jumpers among human athletes, even when the : scene of their feats is America, are of ; Irish descent. It 13 not less certain I
that the best jumpers among horses, especially a large percentage at Continental concours. derive their origin from Ireland, with Australia and England as occasional rivils. From the statistics emerges strong presumptive evidence that the climate even more than the breeding skill tends to strengthen the strain. London Outlook.

Tk riostnv Cvatota and the Wy I la Rcgardrd. About corporal punishment In England two curious facts lie beyond dispute. One is that while the working ola.s and the lower middle class dislike and reaent it and will not In general allow their children to undergo it. the aristocracy tolerate it without complaint. The time is coming, one might atsert paradoxically, when It will be Impossible to flog anybody but the son of a peer. And the other fact la that public school boys have often felt a special affection for the masters who Lave punished them most. In Westminster abbey stand side
by side the tombs of a master and his pupil. The master was Dr. Busby, i who was head master of Westminster ; school for so long a time as flfty-ei.sht ; years. Nobody ever flogged so many , boys as be. The pupil was the theo-

Noted the Symptom. . A little girl went for the first time to church with her mother. All went well during the service, but the child grew uneasy during the sermon, hieh was a long one. The mother tried in every way to keep the littie girl quiet, but in vain. Finally the child observed that the preacher had a pompous way of Inflating his chest and lungs at a new paragraph or head. Just as the mother was assuring the child that the preacher would soon stop, he did for another start and tbe tired child burst out on her mother's assurance, "No, he won't: he's swelling up again."
