ACTION WAS TAKEN BECAUSE OF THE ABSENCE OF PROSECUTOR JESSUP, WHO IS IN A CASE AT GREENVILLE.

The third hearing of the case of the state against Alonzo Kepler, charged with assault and battery on Mrs. Laura EvanF, colored, was postponed for a second time, when called in the city court for a hearing. Attorney Henry U. Johnson, retained by the Evans in the case to assist Persecutor Jessup, petitioned the court to poscpone the case on account of the aoseitce from the city of Mr. Jessup. Attorneys J. F. Robbins and T. J. Study, who represent Mr. Kepler, agreed to the postponment reluctantly and the case was then set for a hearing on Tuesday. November 19. In the council chamber there were assembled about forty men from this city and Wayne township whose names appear on the jury venire for the Kepler case. After the cas? had been postponed these prospective jurymen were summoned to appear before Judge Converse. Ho told them that the hearing of the case had been postponed bytho unavoidable absence of the prosecutor, who was appearing in a case now in progress at Greenville, O. "Do we get any fees for the trouble we have been put to in appearing here this morning?" asked one member of the venire. The court told him that no one would receive any ees and as a result there wfts much grumbling as the forty men filed out of the court room. All those whose n nines appear on the venire have been instructed to report at the city court on Tuesday, Nov. The prosecutor is engaged in a civil suit, at Greenville, O., and he thought that that case would be concluded before now but the prospects are that it will continue until the latter part of this week.

Mrs. Hetty Green's portrait is being exhibited in one of the New York picture galleries showing her wearing the small black bonnet with a bit of white in which she is seen so often. Strange to say she has a small curly dog in her arms, which indicates at least that she loves animals.
