Hinted That Such Course Will Be Followed in the Case Of Green. TWO COUNTS IN CHARGE. JOHN 8, HOFFMAN WAS ALSO INDICTED AND HE WILL HAVE A HEARING ON THE 13TH OF NOVEMBER. The grand jury Friday, after returning an indictment against Verna Green for assault and battery with intent to commit rape, and an indictment against John S. Hoffman, charging him with sodomy, adjourned until Wednesday, November C. The indictment against Green charges him In two counts with aasault and battery with intent to commit rape on three-years-old Hazel M. Harris. The crime with which Green Is charged is punishable by an Indeterminate sentence In the state prison of from two to fourteen years. Judge Fox has set Monday, November 11, as the date for the hearing of the case. It will be tried before a jury and John F. Robbins, who will prosecute the case, is confident that Green can be convict ed on the indictment brought against him. Change of Venue. Although no statement to the effect has been made by Henry U. Johnson, attorney for the defendant, it is regarded as probable that Mr. Johnson will ask for a change of venue on the grounds that Green could not obtain a fair and impartial trial in this county owing to the senttynent which has been aroused against him. Mr. Robbins states that he can convict Green In this county or any other county on the indictment which has been returned against him. The hearing of the cast of John S. Hoffman will be Wednesday, November 13. Henry U. Johnson will represent the defendant. When Hoffman was arraigned in the circuit court a few days ago he entered a plea of not guilty. . FOUR HUNDRED LIS LOST IITHE QUAKE Heavy Toll Is Claimed by Disaster in Italy. Rome, Oct. 26 Loss of life in the quake was four hundred and one hundred were Injured. CHARGE WIFE DESERTION Charles Ebersole Arrested in Indianapolis. Thurslay Sheriff Meredith arrested at Indianapolis, Charles Ebersole, a former well known Centerville young man, on a charge oS life desertion. Ebersole is now conflnoj at the county jail. Last May Ebersole left his wife, ,but he states that since that time he has sent her money regularly. KILLED IN A COLLISION Five Met Death and Seventeen Were Injured. London, Oct. 26. Five were killed And seventeen injured in a collision on the Metropolitan Underground railway today. IS AGAIN IN CUSTODY. ace Johnson Was Found by Officer Voglesong. Grace Johnson, the young Kingman, Ind., girl who escaped from the Home for the Friendless early this morning, is once more in custody. Officer Vogelsong about noon found her walking along the pike which runs from Boston, Ind., to Eaton. O. The girl was about a quarter ot a mile from the state line. She stated that when she got to Eaton she intended to take a traction car to New Hope, where she lived before moving to Richmond. DEP0S!T0RSIN A PANIC. Many Injured in Crush Before Savings Bank. Dr. W. A. Park, one of the well j known young men of Richmond, will be married on Wednesday afternoon of next week to Miss May Berry of Brookville, Ind. The ceremony will be performed at the home of the bride's father, Dr. Berry, and will be witnessed by only a small company. After a Bhort trip. Dr. and Mrs. Park will come to Richmond to reside. Miss Berry, j bride-elect, is a member of one of the best families of Brookville, and a young woman of popularity and many accomplishments. She is known to a number of Richmond people. Albert Kaiser, the nineteen-year-old boy who was accidentally shot by his close friend and chum, Emil Weist, at the Republican club rooms in Fairview, Thursday night, is in a critical condition at Reid hospital. He underwent an X-ray examination at the hospital Friday afternoon, but attending physicians could not locate the bullet. It Is feared that the ball took a downward course on entering his body, causing abdominal inflammation. His condition today points to this. The lad is making a game battle for his llfe, and is showing unusual courage, j but it is feared that the wound he re ceived will result fatally. He is much worse. MRS. STUBBS IS IMPROVED. Mrs. Lewis D. Stubbs has shown a slight improvement since she returned from Chicago where she was taken ill some time ago. ESTIMATES ARE CONSIDERED. The county commissioners met this afternoon and considered the estimates of expenses of the various county officers for-190S. FOUNDATION PLANS ARE NOW COMPLETE Several Contractors Are Figuring on Bidding on This Part of the Work. PROGRESS OF EXCAVATION. IT PROBABLY WILL BE COMPLETED THE COMING WEEK ELECTRIC DANGER SIGNALS TO BE INSTALLED. Plans for the Y. M. C. A. foundation have been completed and several contractors are now figuring on the job. The bids are to be closed November 1, and the foundation work commenced immediately. The excavation work will be completed during the next week. The foundation for the new building is to be constructed of stone and concrete and it is to be very beautiful. Just when the active work on the main portion of the building wiil begin, Local Y. M. C. A. men are unwilling to say. This depends entirely on the speed with which tne foundation is constructed. MENKE John Menke. a well known resident of Richmond, died at his home 20 North Third street, about one o'clock this afternoon. He was ill for several months. He formerly conduct - ed a shoe store on Mam street and was also connected with the Stein shoe company. GRIESWELL The funeral of Fred J. Grieswell will be Monday afternoon. S. Cooney and May Lawson, who have been for some time past, according to the police, the pests of 'Southwest Second street, are under arrest, charged with violating a city ordinance whicn makes it uniawfui . for anyone to annoy one's neighbors by ' J brawling, cursing and otherwise acting in a riotous manner. Mrs. Cooney appears to be a victim of circumstances and was not arrested j. riday nignt when the rest of the household were taken into custody. Officers Staubach and Edwards, who have had their hands full recently quelling disturbances at the Cooney home, stated this morning to City Attorney Study that Mrs. Cooney is used by her husband as a sort of football. It is said that quite frequently when the two men and the Lawson woman become intoxicated Frank Cooney assaults his wife. For over a week neighbors of the Cooneys have been complaining over the actions of Frank, his; "double cousin." and the Lawson woman. The police -have urged Mrs. Cooney to file a charge of assault and battery against Cooney, but she refused to do so and Friday night when the police raided the house, she begged with tears in her eyes that her husband b? left at home. Prosecutor Jessup this morning decided that he could not prosecute the Cooneys and the Lawson woman for intoxication as they were not in a public place when arrested. It was thrn up to the police, as a relief to the residents of Southwest Second street, to charge them with a violation of the city ordinance which pertains to riotous conduct. Last week Fox tendered his resignation to Gov. Harris as a member of the state board of pardons. The resignation was accepted.
