Anderson, Ind., Oct. 16 In order to
test the Indiana law, prohibiting fra
ternities among high school students, the Kappa Alpha Phi fraternity of
young men has retained A. H. Vestal
and the firm of Kittinger & Diven to proceed against the City School Board
for an injunction if the board under
takes to expel from the school such
students as are known to be fraternity members. In further defiance of the School Board this fraternity announced today that it had decided to reopen fraternity headquarters and would proceed to secure more members among students of the high school at this time, and also graduates. The Kappa Alpha Phi has taken a five-year lease on rooms in a business block and bought a complete furniture outfit. The Beta Phi Sigma fraternity will also reopen its rooms. The fraterni
ty members say the School Board has
interfered with their liberty outside of schoolrooms, and, further, that the Indiana law relating to high school fraternities is unconstitutional.
The local chapter of Kappas is to
be assisted in its fight by the national
organization, which has voted $300 to test the Indiana law, and has selected this town for a test case. Mr. Vestal
said today that the papers for injunc tion will be filed this afternoon or to
morrow, unless the School Board should recede from its position. The Betas announced today that they have
lately taken in three new members, and that one is a son of Judge McClure of the Circuit Court. When the injunction is filed it will be in the Superior Court, and the plaintiffs will ask that the case be set for hearing on Saturday, in order that all of the chapters of Indiana may be represented.

secretary of the county board of j health, Dr. Charles Marvel, made an ' automobile trip to a number of points ' in Wayne county to investigate health ' conditions. Fountain City, Hagerstown, Dublin, Milton and Cambridge City were visited and it is understood i the party were able to straighten up
some differences that existed at various places, notably at Whitewater,
in reference to the diptheria scare.

The party visited the I slaughtering establishment of George W. Parsons, three miles north of town I and examined very carefully all de- j tails of the plant. A number of towns j in this section of the state are furn- j
ished with meat from this house and the interest in the visit of Dr. Hurty is not merely local. While Hagerstown has not had an epidemic of contagious diseases for many years and the town presents the general appearance of cleanliness yet Dr. Thurston, the local health officer declares there were dozens of places so offensive as to require instant attention.

Losantville, Ind., Oct. 16. If reports which were in circulation here are
true, Losantville will be spreading her
wings soon and flying high by putting on as many airs as her sister towns. There were several men in town said to be Eastern capitalists, looking over
the ground where the proposed "Wild Flower and Loney Bee" traction line is to run through this place and making specifications for the viaduct where it crosses the Big Four and C. C. & L. railroads. They were making the trip
in automobiles, and after looking over
the ground here, left over the proposed route toward Winchester, via Modoc It was intimated that the grading contract would be let and work commenced yet this fall. It is also said that specifications show that only one bridge would be necessary on the seventeen miles between here and Winchester, which would lower the expense of building the road bed, especially for that number of miles.
