APPELLATE COURT REVERSES THE CASE
Ruling Handed Down in Action Of Noah Myers Against National Drill Company. GOT VERDICT FOR $2,200. THIS WAS IN THE WAYNE CIRCUIT COURT, BUT HE NOW LOSES THROUGH THE RULING OF THE HIGHER BODY. County Clerk Harry E. Penny has been informed by the clerk of the appellate court that the verdict in the Wayne circuit court against the National Drill company in favor of Noah , Myers had been reversed by the appellate court. . The ruling of the superior court Is as follows: 884. National Drill Co. vs. Myers. Wayne C. G. Reversed. Myers, J. (l)Stating the facts shown by the record In appellant's brief so the court can understand what questions are presented and how they were decided below, is sufficient without setting out a demurrer literally. (2) A plaintiff, counting on defendant's failure to provide an emery wheel at which plaintiff worked with "exhaust fans" . . for carrying off dust from emery wheels" as required by Section 70871, Burns, 1901, has the burden to allege and prove that an exhaust fan could have been provided without interference with the use of the wheel. The case of Myers against the drill company was heard in the Wayne circuit court early in 1 D05. Myers sued for damages, alleging that he had been injured while in the employ of the National Drill company, through negligence on the part of the defendant. On Mar. 9, 1905, the jury which heard the case, returned a verdict of $2,200 In favor of the defendant and the case was at once appealed to the appellate court by the attorneys for the National Rrill company. The Woman's club held a very interesting and profitable meeting Monday afternoon at the home of Mrs. E. V. Teas, Mrs. Mary Teas presiding. The house was beautifully decorated with ferns and gladiolias. The author of the day was David Graham Phillips. Mrs. Emma Beitzell gave an excellent biography and Mrs. Cora Demoss read two very interesting articles concerning "The Making of the City Slums," and "In Whom the Literary Critics see the Long Looked for Great American Novelist." lit BALLOON ASCENSION IS COMPLETE SUCCESS Prof. Barnard Pleases Crowd At Economy. Economy, Ind., Oct. !. The balloon ascension Saturday evening was a success. Prof. Barnard went up in the big balloon and threw out a rooster. The bird circled then headed for the earth and landed safely. The parachute was sot cut loose until y.00 feet above the earth. It floated gracefully with Mr. Barnard southeast and landed in a big tree in John Franklin's woods, one and one-half miles from the starting point. There was a concert by the Mooreland band. ABSENTMINDED. A Story of Bunsen, the Great German Scientist. In the autobiography of Sir Henry Roscoe there is a capital example of the absentniin'.'.edness of Bunsen, the great Gerrnau scientist. He had hnd his evening clothes put out that he might attend a card party to which he had been invited, but forgot all about It until the next morning, when his man pointed out that the evening clothes had not been worn. And then he remarked to himself, "I know what I'll do." That evening he put on his dress clothes, went to the lady's house at the appointed time and walked in as if it were the day upon which he had been invited. The hostess, much too polite to tell him that he had mistaken the evening and that the party had taken place on the previous night, sent to' her friends asking them to come in to play a rubber again. They did so. In the course of the evening the conversation turned on absentmindedness, and Bunsen began to tell them what hnd happened to him a long time ago how that he had forgotten an Invitation and how he had made up his mind to go the next night and thus he told the party the whole story, forgetting altogether that he was giving them an account of what was happening at the very moment. Brought to Terms. In the Drayton household it Is said that the father of the family has a way of presenting alternatives to his children that never fails to bring them into line. "I wish you would speak to Bobby," said Mrs. Drayton one night. "I've told him to take his medicine and then jump into bed. and he won't do it. He just hops around and says he doesn't want to take the medicine and he doesn't want to go to bed." Mr. Drayton stepped to the door of Bobby's room and stood there, tall, grave and impressive. "Bobby," he said tirmly. "If yon don't take your medicine at once and then jump into bed you will be put to bed. do you hear me. put to bed, without having your medicine at all." I have just been examining an old book containing the accounts of the charity estate of West Iladdou, embracing the jears 1773-1S50. Under date Aug. 17, 177G, is the following entry : 'Taid Richard TVorster seven days' work, cutting thorns and scowering and stoping of gaps, 10s. 6d." M'MANUS' HARD WORK PROVED OF NO AVAIL
Got Jurymen But Kepler Case Was Postponed. WILL BE HEARD OCT. 30. The Illness of Mrs. Evans the prosecuting witness in the case filed by the state against Alonzo Kepler for assault and battery, prevented the third hearing of the case in the city court. Jurymen summoned to sit in the case at the instigation of Judge Wm. C. Converse, returned to their homes. The next hearing of the case, which has already occupied much time in the city court, wili be October 30. Sergeant McManus of the local police force was about the busiest man in the county Tuesday summoning jurors to appear in Richmond. He summoned nineteen farmers residing south of Richmond and drove about the country the greater part of the day in his search for available men. Owing to the condition of the weather, farmers were not occupied at their farm work and were off attending to business matters and hence it was a very hard job for McManus to secure nineteen men. In all just forty-two prospective jurors wer-3 summoned to appear in the city court. A number of Richmond men were selected. As the attorneys, both for the ?tate and defense, have other cases to which they have to turn their attention the Kepler hearing could not be set until the latter part of the month. But his success was short lived, and the tide of war turned against him. Defeat and disease decimated his vast host until there remained but four riders of them all who made their way to Worms. "The Jew has not spoken the truth." he remarked as the gates of the city came In sight. "He said we should return with only three riders and a horse s head. He has lost bin reward." They rode up to the gates and demanded admission. The massive door behind was raised, and they passed through. But as the fourth rider was about to follow it fell down again with a heavy thud, decapitating the horse and leaving Its trunk and burden outside the city. NEW CYLINDER SHAPED VAULT BEINGINSTALLED Improvement at Cambridge City National Bank.
A SEVERE TESE WAS MADE. Cambridge City. Ind.. Oct. 0. A new cylinder-shaped vault is being installed in the First National bank of this city, which will better accommodate the increasing business of this institution. , The old vault that was taken out in order to make room for the new one. has been in service for over thirty years. The old vault having been built in a brick encasement, has several holes almost eaten through by the mortar. To demonstrate the burglar proof qualities of the vault eight ounces of nitroglycerine was exploded in one without doing it any damage. BURIAL AT HAGERSTOWN. Mrs. Conrad Was a Member of the Rebekah Lodge There. Hagerstown, Ind., Oct. 9 Burial of Mrs. Mary Conrad, who died Tuesday afternoon at her home at Richmond, will be held here Thursday afternoon at West Lawn cemetery. Mrs. Conrad was formerly a resident of this place and was a member in good standing in the Victoria Rebekah lodge of this place. CHAS. TEETORBUYS FARM. He Gets the Dinah Teetor Farm at $100 Per Acre. Hagerstown, Ind., Oct. 9 Mrs. Dinah Teetor has sold her farm of 32 acres to Charles Teetor at $100 an acre. It is located one-fourth mile west of town. Teetor will probably build a residence there and move to that place. MRS. JAMES MURRAY HOSTESS. New Paris, O., Oct. 9 Mrs. James Murray entertained a large number of friends at her country home, east of town Saturday evening, in honor of her daughter, Mrs. Cora Swisher of Dayton. Music and Fames were the amusements of the evening and afterwards refreshments were served. There were thirty guests present. LucKy J-or Her.
