Prosecutor Jessup has raised a point as to whether E. K. Shera, who has Just been appointed a member of the board of police commissioners of this city, can serve in this capacity. Mr Shera has not yet received his commission and states that he will not serve on the board until it has been definitely decided that he has the right to do so. Under the acts of the Indiana legisla ture In 100.", it is unlawful for any cit izen to serve as a member of any board of metropolitan police commissioners if he is In any way connected with the city government or has any contracts with the city. Mr. Shera is one of the partners in the firm of Shera & Starr, coal and Ice dealers, which, concern has In the past entered into contracts with the city for supplying coal to the Municipal light plant, the city building and other places, under the control of the city. Mr. Shera states that at the present time his concern has no contract with the city to supply coal and that the pros pects are the company will not enter into a contract with the city for at least another year. At the same time if Mr. Shera ac cepts his appointment to the police board, it will be n'essary for his com pany to avoid entering into any contracts with the city. Mr. Shera wonders if the honors that go with the office he has been appointed to, are sufficient to warrant the loss of business. T IS RETURNED; CHARGE IS LARCENY (Continued From Page One.) Mrs. Penland that he had given Hunt $75 Instead of $,"0 for the timber. Since going to Galesburg, Hunt has been employed on a farm near that city. When Chief Bailey arrived .it Galesburg, he went to the sheriff, who detailed his deputy to go with Bailey to the farm where Hunt was employed. On arriving there they were informed that Hunt was in the city. On returning to Galesburg Hunt was found on the streets and placed under arrest. He took the situation calmly and told Chief Bailey that he would return to Richmond without causing any unnecessary delay. Hunt will be arraigned in the city court and bound over to the circuit court. He has retained Attorney V. A. Bond to defend him. Hunt, during his residence in this county, was well known as a horse trader. He is a young man, and so far as known has never been in any trouble before. Cassie Chadwick, wizard of finance, is again In the penitentiary hospital. Sunday afternoon, while talking with her son, Emil Hoover, of Cleveland, she was suddenly siezed with an attack of neuTaliga of the heart. She was rushed to the hospital and for a while was in a dangerous condition. Today she had partially recovered, but upon adTlce of the prison physicians she will remain in the hospital several days. GROVER CLEVELAND IS III EXCELLENT HEALTH Denies Report That He Has Serious Ailment.
SOON TO BE AT OFFICE. Princeton, N. J., Sept. 16. Grover Cleveland arose this morning at the usual hour and had a hearty breakfast and took the usual morning drive. Report that the former president's health has failed was met with a denial at the Cleveland residence. "Mr. Cleveland is in excellent health," said the former chief magistrate's secretary "T:"is no occasion for alarming reports. He expects to be at his office In New York in a few days." ALLEGE ITJS A TRUST Hearing of Standard Case Is To Be Resumed. New York, Sept. 16 Judge Franklin Ferriss will tomorrow resume the hearing of the Standard Oil case in this city. This case seeks to dissolve the Standard Oil company on the theory that it Is a trust. CONVEYANCE TO BE PROVIDED. A number of Richmond people will attend the annual reunion of the Sixty ninth Indiana, which will be held at Fountain City, next Nhursday. Those attending the reunion from here will go on- a conveyance which will leave the Arlington hotel at 8:30 a. m., Thursday. City and County STATISTICS. Deaths and Funerals. KATES The funeral of Harry Kates, which was held Saturday afternoon at. the home was attended by many friends and relatives of the de ceased. The Rev. W. M. Nelson, pas tor of Grace M. E. church, officiated. Burial was in Earlham cemetery. The pall bearers were W. R. Dill, Frank McCurdy, Charles Marlatt, A. L. Studv. James Finfrock. and C. P. Holton. FRANK SMITH VICTIM OFJIUSSAULT Aged Man Was In a Serious Condition for Some Time As Result of It.
WILLIAM BOLAND IS HELD. HE IS CHARGED WITH ASSAULT AND BATTERY WITH INTENT TO COMMIT MURDER DETAILS OF THE CASE. Frank Smith, a man about C5 years of age and custodian of the old Akron hotel building, was assaulted Sunday afternoon In such a vicious manner by William Eolland that his life was at first dispaired of. Holland Is being held by the police under a charge of assault and battery with Intent to commit murder. Dr. Charles Marvel states that Smith, despite his advanced age, Is surviving the assault nicely and that the chances for his recovery are good. Smith tad three ribs on his right side fractured and his face is a mass of sore.?. The police are not in possession of many of the facts in connection with the assault. Holland states that Smith had acted in an improper manner with Mrs. Holland and that he assaulted him for this reason. The police also learned that last Friday a woman said to be of bad reputation, whose name Is not known as yet, stayed in the Holland apartments at the Akron hotel. Smith informed the Hollands that she could not stay there. Saturday night this woman returned to the Holland apartments. Sunday afternoon Smith learned of Tier" return and went to Mrs. Holland and told her that the woman could not remain. It is understood that Holland then assaulted Smith, knocking him down and kicking him in the face and ribs. Police on the Scene. When the police arrived Smith was found to be unconscious. Mrs. Holland, who was drunk and Mr. Holland were in the room, v The Hollands were taken to police headquarters while Smith was removed to the home of a relative. On arriving at the Holland apartments the police discovered Moll Lewis, a notorious Centerville woman, and John Sebastln in one of the rooms. These two were hauled to the city jail. Today Smith Informed Dr. Marvel that when he arrived at the Holland apartments he found Holland and his wife engaged in a drunken quarrel. He tried to pacify them and as a result Holland assaulted him. Mrs. Holland was so drunk that the police had great trouble in removing her to the city jail. Empty whiskey bottles were found strewn about the rooms. Sebastin was arraigned in the city court on a charge of associating. He entered a plea of not guilty. The court sustained a motion of the prosecutor to postpone the hearing of the case until Tuesday morning and to have the cfise heard before a jury. Moll Lewis entered a plea of guilty to a charge of having visited a house of ill fame. She was fined $10 and given a ten days' jail sentence. Mrs. Holland will be charged with Intoxication. The police alleged that she Is not married to Holland and she may be charged with another offense as a result. The police state that the Akron hotel has as- unsavory a reputation now as it had before the Inforcement of the blue law two years ago. PREACHING; QUARTERLY CONFERENCE. Vessels made of glass that have been suddenly cooled Iostsess the. curious property of being able to resist hard blows given to them from without, but will be Instant ly shivered by a small particle of flint dropped into their cavities. This property seems to depend upon the comparative thickness of the bottom; the thicker the bottom is the more certainty of breakage by this experiment. Seme of these vessels, it is stated, have resisted the stroke of a mallet given with sufficient force to drive a nai; into wood, and heavy bodies, such a? musket balls, pieces of Iron, bits of wood, jasper, stone, etc., have been cast into them from a height of two or three feet without any effect, yet a fragment of flint not larger than a pea dropped from a height of three inches has made them fly.
