Constitutionality of the Indiana Measure Will Be Tested in Court.

POINTING TO HEP3URN ACT, THE MISSOURI PACIFIC DENIES TO RIGHT OF STATES TO FIX THE RATES.
Washington, Sept. 4. The constitu
tionality of Indiana's 2-cent-fare law
and those of other states that have
passed like statutes is involved in a case just filed in the United States Supreme court in which th contention 53 made that under the provisions of the Hepburn rate act all railroad companies engaged in transporting commodities between the states are under the exclusive jurisdiction of tae interstate commerce commission, and further that the states have lost all supervision and control over railroads within their borders. The Missouri Pacific Railroad com
pany has brought this case to the Supreme court. The Larabee Milling company, of Stafford, Kas., operated a mill on a spur leading from the Missouri Pacific's main line. The Santa Fe road crosses the Missouri Pacific at Stafford about a mile from the mill. For many years the Missouri Pacific delivered cars to the mill and moved them from the mill off the Santa Fe tracks at a charge of $2 per car. Some months ago it ceased being a switch agent for the Santa Fe. The milling company instituted mandamus proceedings in the supreme court of Kansas to compel the Missouri Pacific
to continue the arrangement and secured the issuance of a writ from which it appeals to the United States Supreme court.
Business Interstate. In the trial of the case it was con
ceded that three-fifths of the business of the mill was interstate business. In Its appeal the Missouri Pacific makes the bold claim that it is subject to fed
eral control only that under the provisions of the Hepburn act the various states have lost control of the interstate roads so far as operation of the roads are concerned, and that the Kansas supreme court wa. without jurisdiction in the case brought by the Larabee Milling company. "There is not a single detail of rail
road operation," reads the brief filed in the case, "which is not provided for by the interstate commerce acts and other acts relating to interstate carriers. The rails of many railroad companies extend continuously from ocean to ocean. Every car is engaged,
more or less, in the transportation of
commerce between the states. That
the regulation of commerce and all in
strumentalities of commerce is a na
tional question no one can gainsay or
deny.
Aim of Hepburn Bill.
The passage of the Hepburn bill and
the provisions of the same, taken in connection with the original interstate commerce act, most conclusively dem
onstrate that it was the intention of
congress to place every officer, employe
servant and agent, as well as the busi
ness of every interstate carrier, includ
ing the tracks, cars, equipment and in
strumentalities of every kind, nature and description, under . the exclusive control and supervision of the interstate commerce commission.
If the opinion and decision of the
lower court shall be carried out to its logical conclusion and result the "regulation of commerce" will be thrown into endless confusion, and, although the question is one of national character and importance, the states may divide the responsibility with the federal
government and make orders and establish rules and regulations which will embarrass and perhaps in many In
stances prevent common carriers, sub
ject to the provisions of the act of congress, from complying with their du
ties and obligations as prescribed by
the express mandates of the federal government."

Muncie for the following year, will be the headquarters of the state organization of the Knights and Ladies of the Golden Eagle. At the annual meeting of the delegates of the order from all parts of Indiana, it was decided to make that city the one from
which all the state affairs shall be directed during the coming 12 months. It was also iV;cide to ask the Grand lodge at its national meeting in Huntington, W. Va., next week, to establish the permanent state headquarters
of the Indiana organization in Muncie.

It Was t'na Means of Bringing a Murderer to Justice. Scraps of paper have on several occasions been the means of throwing light on some of the greatest criminal mysteries of modern times. Had i not be?n for the minutest scrap o' tissue paper it is quite possible tha, the notorious Franz Muller would have remained a free man to the end of hl days. After foully murdering a Mr. Brigs.in railway carriage on the North London line Muller made off with his victim's hat. When caught several months later a top hat declared to be Mr. Brigss was found in his possession. Its shape, however, had been considerably altered, and Muller in sisted that the hat had been bought by himself. Was it Mr. Briggs hat? "If it is Mr. Brlargs hat," said the hatter who supplied him, "you niajfind a piece of tissue paper in the lining. Mr. Briggs' hat v,an too large for him, so I put the paper in to make it fit." When the l'aing was turned down a scrap of paper which had adhered to the leather was discovered. Muller had a bigger head than Mr. Briggs and had therefore resolved to take the paper ut. He left that little bit, however, sufficient to establish the identity of the hat beyond all question as that Mr. Brings was wearing when he was murdered. Mr. Chase has been conducting an in
vestigation for the past two weeks and is expected to commence proceedings within the next fortnight.
Benjamin Purnell, head of the
"Home of David" of this city, is defiant. In a statement this afternoon he declared:
"You bet your boots we will contin
ue ot do as we have been doing. We shall mind our own business, and the House of David shall live and thrive as It has done in the past." The action Mr. Chaso will take will be in the form of quo warranto proceedings asking the colony to show cause why its charter should not be taken from it. Mr. Chase declares that he is sure of his ground in this direction, as the "House of David," now incorporated merely a3 a church organization, has been operating as a business concern in violation of the act under which it was organized. Leader Says ne Will Fight. Purnell insists that he will fight this move to the highest court in the state. The part that Thomas Erskine, British vice counsul at Chicago has been playing in the investigation is due to a complaint lodged at the British consulate by William Cleveland, a native of England and former member of the long-haired colony. ing that there were British subjects at the "House of David" who came here from Australia nearly two years ago, the vice consul made an investigation. The British government, however, will leave all legal action to
the state of Michigan, offering only suggestions as to what form it will take and what course will be pursued. The Twin City Ministerial association, composed of Clergymen of this city and St. Joseph, is a leading factor in the investigation. This organization which has been conducting an investigation by itself for the last month has collected valuable evidence and today gave it over to the attorney general department. State has Hard Problem.
Mr. Chase admitted that he had somewhat of a difficult problem to solve. "Where religion fanaticism, graft and deception are all on," said he, "it is pretty hard to proceed." The policy of the state will be first to commence legal action toward
straightening out the business affairs of the colony and then to probe the
charges of immoral conduct which have been made against Purnell and
some of his followers. Attorney W. P.
Harvey, leading counsel for the House
of David, made this statement tonight: "It is true that the colony has out
grown the charter under which it was
organized, but we believe these dim"
culties can be straightened out with
out trouble. We do not view the in
vestigation seriousiy, neither do we
fear it."
