the May term of the supreme and ap-

courts were cleared. Twenty-one decisions in all were handed down. In affirming a judgment of the Jay

circuit court for fees for procuring

missioners, the supreme court held that a county auditor has no legal

right to tax and collect such a fee.

The court held that an appropriation

by the county council to pay back the money is not necessary before a town

ship can recover such a fee illegally exacted from it.

firmed the case of E. E. toster, in which a proceeding under the old act for the improvement of a road in Tipton county had been dismissed. The supreme court also reversed the judgment declaring Mortimer Buchanon duly elected as councilman of the city of Lebanon. Buchanon claimed the office on the ground that his successful competitor in the opposite party was not eligible to hold the office of councilman because at the time he was elected he was an officer of a

The court, however, held that it is sufficient if a candidate becomes eligible in time to take his office, without regard to his eligibility at the time he was elected. The presiding judge in the appellate court for the term w'll be Judge Daniel Comstock of Richmond. Holding that a city ordinance, not only forbidding saloons outside of the business part of the city but also defining the boundaries of the business part of a city, is valid, the supreme

i court reversed a judgment in favor of

John V. Thompson in a prosecution against him for violating a city ordinance at Greencastle. Thompson was charged with keeping a saloon near the Big Four station in Greencastle. A new trial was ordered. The court also declared that the state may authorize saloons to be licensed and that the saloon business is lawful except as declared unlawful by the state. In relation to the ordinance the court held that the only grounds upon which an ordinance as that at Greencastle can be attacked is that the city has been guilty of an unreasonable abuse of its power and discretion in declaring the boundaries

Frank Caley, one of the book agents operating in this city, and who was arrested last week for obtaining money under false pretenses, was arraigned in the city court on that charge and plead guilty. Judge Converse fined him $20 and costs and gave him a jail sentence of ten days. Caley was represented by Attorney John Spann of Indianapolis. Owing to extenuating circumstances in the case. Prosecutor Jessup recommended leniency on the part of the court. He explained that the money obtained by Caley was from Fred G. vilber, who is the head of the International Educational association, a subsidiary incorporation under the Lippincott publishing company. Wilber has agents working in various districts in this state under the supervision of the state agent. Each agent receives ?3 commission from Wilber when the agent turns in a contract for a set of

books. In the affidavit sworn against Caley the .young man was charged with turning in a bogus contract for a set of books made out in favor of Mrs. J. A. Chamness of this city. The prosecutor stated that he had learned that out of twenty-one other orders turned in to the state agent to be transmitted to Mr, Wilber. seven had been found bogus and about ten were suspicioned as being forged.
