TOOK OATH BEFORE JUDGEJCOHVERSE Elmer Smith Makes Promise To the Court That He Will Never Drink Again.
HE THUS ESCAPED A FINE.
CONVERSE HAS ENTERED TEMPERANCE FIELD AND AWAITS THE OUTCOME OF THE FIRST CASE WITH INTEREST.
Judge W. C. Converse of the city court, has invaded the temperance field and he expects his venture to be a complete success. Elmer Smith, a middle aged man with a wife and five children, was arraigned before him on a charge of public intoxication. A pre
vious offense was also charged against Smith. Smith entered a plea of not guilty as he stated that he knew nothing of his actions Wednesday. Two police of
ficers then testified that the. man had
been quite drunk. Smith then made a
fervent plea for mercy from the court, stating that he had a large family
which needed his support and that he
was not addicted to indulgence in etrong drink. Given a Strong Lecture.
. Judge Converse summoned Smith to
his private office and there he lectured the man on spending his money for
drink when he knew that his family
needed all the money he could earn. Smith stated that he realized this fact and that he would swear never to again enter a saloon or come down town Bgain. He said that he rarely drank whisky, but that when he did it required but a small amount to make him drunk. '"Will you take an oath to leave hooze alone?' asked Judge Converse. "I will, jour honor," earnestly replied Smith. Judge Converse then asked Smith to pive his word and honor as a man that he would never again drink intoxicating liquors; that from this time on he would keep away from temptation and that he would work hard for the support of his family and devote his wages for their benefit. Smith Took the Oath. Smith stood before the police judge and took the oath, then thanked Judge Converse with tears in his eyes for giving him a chance to reform and make a man of himself. The case against him was suspended, but Judge Converse warned Smith that if he was false to his oath and ever appeared before him again, not to look for the slightest consideration. Judge Converse stated that Smith's family needed the money much worse than the county did and that he gave the man a chance to redeem himself because he seemed to really repent his offense. If the experiment of administering temperance oaths proves to be a success in this case, it is probable that Judge Converse will adopt it as a part of his administration f justice. OUTLOOK FOR FESTIVAL IS VERYJFLATTEHING Little Doubt That May Event Will Prove Great Success.
GOOD REHEARSAL HELD.
The May Festival chorus rehearsal which was held Wednesday night at
the coliseum, was probably the best
that has been held up to date, as there
was a larger number present and
great interest was manifested in the work. The chorus has almost learned the scores on the Requieum, one of the hardest pieces of music ever attempted by a festival chorus. Prof.
Will Earhart who has charge of the
work, says the words and music have been almost learned and a large portion of the work from this time on
will be along lines of technique and proper rendering of the selection.
Advertising to Begin.
Mr. Earhart has received a conmu-
nication from Frederick J. Wessels, manager of the Theodore Thomas orchestra, saying window display cards, advertising the orchestra and singers,
will be forwarded to Richmond at an early date, probably next week. Circulars have been received In this city giving briefs from various newspapers over the country, telling of the great work of the quartet which will appear here this year.
As the time approaches for this
year's great festival, the directors and chorus are becoming more enthusiastic and it promises to be the greatest ever held, both from the point of beauty and financial returns.

THE FIRST DW OF SPRING. Indications That Bad Weather Sometimes Encountered Will Be Missed This Year.
Thursday, March 21 is the first day of spring, and from all appearances spring will be marked by beautiful weather, and it is also probable that the old tradition regarding the coming in and going out of March will be shattered. March is more than half over and the rough weather usually due at this time of the year has not
made its appearance.
Washington, March 21. The president's evident sympathy with numbers of prominent railroad men who have expressed themselves in full accord with the aims of the Hepburn law and satisfied with its operations- has mystified many observers, who have also
been unable to understand the appar
ent misgiving with which the president views much recent anti-railroad activ
ity on the part of state legislatures. It is) now largely believed' by the shrewdest observers' here in Washington; that the explanation of this remarkable consensus of views on the part of President Roosevelt and prominent railroad men may be found in the proposition that an effective and constitutional regulation of the great railroad systems of the country can only be had under the acts or authority of congress, through the interstate
commerce commission or otherwise
and by virtue of the interstate com
merce clause of the federal constitution. The principal ground upon which
this conclusion has been reached is the practical certainty that nearly everything a state government is likely to do in regulation of rolling stock or
rates will trench on the federal prerogative of controlling interstate commerce. Recent outgivings of the president follow closely along such lines. A fuller and keener examination of the subject than has yet appeared has been obtained from a promient railroad man who has been a party to recent conferences. What he says is very impressive and suggestive, though not, doubtless, final, as follows: The General Principle. "Whatever power congress may have to regulate rates of Interstate railroads isderived under the commerce clause of the constitution of the United States. It is limited to Interstate rates. The power of a state to regulate rates is limited to the ter
ritory of the state. Congress may not legislate upon a railroad, or any other subject, purely local to a state, nor may a state extend the operation of its laws beyond the boundary line
separating it from other states.
"Having sole jurisdiction of the sub
ject, congress may sanction a given interstate rate in either of two ways: First, by positive act of legislation fixing such rate, or, second, by permitting a rate, voluntarily fixed by a railroad, to remain in force without undertaking to change it by legisla
tion. For example, congress, through the interstate commerce commission, reduces the rate fixed by the railroads on grain from Chicago to New York, but takes no action on the rate on live stock between the same points. In the one case the rate has express legisla
tive sanction, in the other implied legislative sanction. In both cases the two rates are equally within the pro
tection of the commerce clause of the
constitution of the United States. All
interstate rates now In force, until
changed by the voluntary act of the railroads, or by a ruling of the interstate commerce commission, are, for all purposes, lawful, and so to the same extent as if the various schedules expressing them had been enacted into a law by congress. "The fabric of interstate rates in the United States may be wholly artificial, illogical and unjust. It may be conceded that some master mind will sooner or later, devise a rate scheme vastly better for all interests than the one now in use. However this may be, the interstate rates now in force, taken collectively or separately, are, one and all, the law of the land and must so remain until changed by congress.

Laporte, Ind., March 21 Announcement was made today that the Murdock syndicate which recently bought the property of the northern Indiana railroad connecting Elkhart, Goshen, South Bend, Laporte, and Michigan
City, will build a traction road from Laporte to Logansport, a distance of sixty miles and will thus connect with
Chicago and Indianapolis.

Be It Resolved by the Board of Public Works of the City of Richmond, Indiana, Thatit is desired and deemed necessary to construct a Sewer System in the South West portion of the City, which system by its size and character is not only . intended and adapted for use by property owners whose property immediately abutson the line of the said sewer, but is also intended and adapted for receiving sewage and storm water from collateral sewers and drains already constructed, or which may be hereafter built, and that the said Sewer System be and is hereby ordered to be built in accordance with the profile, plans, maps, specifications and estimates now on file In the office of the Board of Public Works of said City. The cost of the said improvement shall be assessed as follows: So much of the cost thereof as shall be equivalent to the cost of an adequate local sewer, not adapted for receiving sewage from collateral sewers or drains, shall be assessed against and paid by the property immediately abutting on said sewers?
