will prevent discrimination against the
uniform of the army or navy. Several
cases involving tms question are pending In state courts, but the more recent case of refusal by a skating rink proprietor at Plattsburg, N. Y., to admit two soldiers in uniform,
which was sustained by Judge Everest of the city court, gives impetus to tho
movement set on foot by the president
some time ago to insist that the uniform shall be recognized in all public
places.
Judge Everest recently wrote the
president, stating the grounds on which he based his decision, main
taining in effect that the case is not within the meaning: of the bill of
rights, affecting the question of race,
creed or color. He frankly expressed the opinion, however, that the matter should be taken up by congress and a bill passed making it an offense to discriminate against the uniform of the army or the navy. "
This letter was referred by the pres
ident to Chairman Jenkins of the house judiciary committee, who took
rather conservative view as to the
right of congress to deal with the
question, but suggesting that the opinion of the judge advocate general and the attorney general might be sought
in reference thereto. Chairman Jen kins, at the same time, related two instances which came under his personal observation, where proprietors of public cafes went to guests and
notified them to wear their coats or else leave the premises. Chairman
Jenkins said this was not a discrimination against the guests in question, but an objection to their mode of dress, a position in which he thinks
the proprietors were justified. Acting on Chairman Jenkins' suggestion, the whole subject was referred to the at
torney general for his action.

Barr, a newspaper man from Vincennes, he felt like shaking hands with himself, for he felt almost certain that he could place his hand upon the man in five minutes. That John Burns, an inmate of the county jail, and the missing Barr were one and the same he was ready to take oath, and the striking resem
blance between the two certainly warranted the belief. But the sheriff investigated, and as a result of his Inquiries among friends and acquaintances of the occupant of the bastile, as to his antecedents, discovered that he was just "John Burns." and had
never lived In Vincennes. - Neverthe
less, Barr and Burns look enough alike to be mistaken for twins. One reason that caused Meredith to think
that his prisoner might be passing un
der an assumed name, was the fact that it is with great difficulty that he

In a practice game last night In the
Earlham gymnasium, the Varsity won over the Kibbeys by the good margin
of 34 to IS. During the first half the varsity presented its strongest lineup and aided by the stellar work of Mote and Kerlin at forward, succeeded in piling up a 23 to 6 score in the first half. In the second half the squad
men were used by the Quakers, and
the Kibbeys, by the excellent work
of Ray and Allison, were able to lessen the margin to a considerable ex
tent, Gaston played a consistent
game at center. . During the second half, Genn, at center, showed up well for the Quakers while Hotchkiss at guard, played a good game.
One of the most noticeable features
of the game was the Quakers' inability to hit the goal. The lineup of the

fPuMlshrs Pressl New York, Jan. 31. The grand jury has returned a blanket bill of indictment against all of the members of the so called theatrical trust. The bill was presented to Judge Foster today in Part 1 General sessions. .The theatrical managers named in
the sweeping indictment are Marc
Klaw, Abraham Erlanger, composing
the firm of Klaw and Exlanger; Sam
uel Nixon and J. F. Zimmerman, com
posing the firm of Nixon and Zimmer
man; Charles Frohman and Al. Hay-
man. Tne two latter are in Europe.
Klaw and Erlanger appeared In
court this afternoon in response to notification received from their counsel.
Alfred L-auterbach, and were admit
ted to bail in the sum of $1,000 each. Bail was furnished by Timothy D. Sullivan ("Big Tim") before Judge Foster, the amount being fixed with the consent of District Attorney Jerome and Mrs. Lauterbach. "Big Tim" gave as security the Dewey theatre, In East Fourteenth street, which he said was worth $300,000. Pleading on the indictments was put over for one week. Nixon and Zimmerman are said to be in Philadelphia, and it is expected they may return to the city to give bail some time tomorrow. ' The specific charge against the men is conspiracy in restraint of trade in violation of a state law that makes the offense a misdemeanor.

Models Badly Defeated. The Models, a team of alleged basket ball players, journeyed to Greensfork last night, where the farmer lads were enabled to get a little practice. The score was 42 to 6 in favor of Greens fork.

Henry Miller, farmer, began 2,140 suits against the Chicago & Northwestern Railway company for $21,400 or $10 for every locomotive that has crossed his farm since advised the railroad company is to construct a culvert anl crossing at the point where the railroad crosses his farm. The complaints in these cases fill about 600 typewritten pages. Heavy Snow in Berlin. Berlin, Jan. 31. The city of Berlin was snowed up Thursday, as IS inches of snow fell during the night. Not a street car moved and downtown t thoroughfares were impassable for cabs or omnibuses. Nothing like It was witnessed here in a generation. The Starr Piano company of this city will establish what is to be known as a Pacific division of the firm at Los Angeles, Cal. This departure is taken with a view to facilitate the rapidly growing business of the company in the west. The resident managers of the new division will be H. S. Jones and Harry L. Nolder. who
have been connected with the company in this city for a long time. Harry Gennett has been selected as president. Mr. Jones has been head salesman for the company for about twenty years and has a very extensive knowledge of the piano business. Mr. Nolder is at present head of the wholesale department, having served in that capacity for sixteen years. It is the intention of the company to make several improvements in their local plant, most important of which wll be an addition to the main line of buildings. This new structure will be built of brick and steel and will be six. stories high, and is to be one of the most modern factory buildings In the country. "When this improvement s completed the Starr company wi' haye the largest plant for the manufacture of pianos in the country. Bids for the new " building will be advertised for In the near future. The company will also greatly increase its switching facilities. More than 60,000 pianos manufactured by the Starr Piano company are in use in various parts of the United States.
