AT THE THEATERS Repertoire at the Gennett. Every Indication is that the Gennett is to have one of the best weeks in its history in tho wayof repertoire, with a large amount of vaudeville thrown in, affording the public virtually a double bill for the one popular price. Last night the Record Stock Company, headed by Miss Cora Lawton Mitchell, presented "La Belle Marie" in a most acceptable way to a large and appreciative and enthusiastic audience. The play was properly costumed . and given suitable stage settings and Miss Mitchell has has capable support throughout. A most acceptable repertoire has been made up for tho week, affording the public an opportunity to see a large uuruber of standard plays. For the matinee today the bill is "How Dunne was' Done," and the program for the remainder of the week is as follows: Tuesday night, "A Prisoner for Life,"; Wedncsdv matinee, "La Belle Marie"; Wednesday night, "Camille"; Thursday matinee, "The I Hack. Flag"; Thursday night. "A Wife's Honor"; ' Friday matinee, "Camille": Friday night, "Golden Giant Mine"; Saturday matinee. "East Lynne"; Saturday nignt, "John Iartins , Secret." The specialties to the matinee is ten cents. Despite the nearness of the holiday season, the most liberal of patronage is expected. Vaudeville at the Phillips. Well pleased and entertained was the large audience that gathered at the New Phillips last night to witness the performance in vaudevilie Manager Murray has made a happy se lection in the various acts as they afford a strong combination with suffi cient variety to make the offering one of the best. James and Cecila Welch have a comedy sketch that is a fun maker. The Acrobatic Hills are asgood in their line as one would care to see and with their stunts introduce " " itbe average of the kind. The Juvenile !of a wonder as a fun maker and performer and gets tumbled about as thought he were made of rubber. FREDERICK WARDE COMING WILL APPEAR AT GENNETT. Celebrated Actor Will Give a Shakespearean Recital Monday Evening . Was Formerly With Booth, Barrett and Others. , , Frederick Warde, the celebrated actor, who will appear at the Gennett next Monday evening in a Shakespearean recital, for many years played leading roles with Booth. Barrett and other noted actors and is known to the theatre going public of this country as one of the greatest exponents of Shakespeare on the contemporaneous stage. His appearance here in dramatic recital will be a notable event, his appearance in dramatic recital for the past two seasons in all the leading cities and great universities of the country, having been immensly successful. His first lecture at the University of California created great enthusiasm the students crowding the hall where the recital was given, large numbers being unable, to find standing room. His recent engagement in fndianapolis, wher he delivered a series of lectures and recitals, attracted widespread attention. "Travels of a Barrel," "Tit for Tat. Jj. xiie light of the Standard Oil company against the 10 indictments against the Standard Oil company of Indiana, which were returned Aug. 29, was commencea in th6 United States district ' court before Judge Landis. The Indictments contain 6.42S counts, to which the Standard Oil company entered a demurrer, on which the proceedings are based. Attorneys for the Standard Oil company contend in support of their demurrer that section 10 of the rate law passed by congress June 29 repeals the Elkins law, under which the government is bringing the action against the company, and that the indictments are. not sufficiently specific, because they do not comprehend all the elements in the case. In reply to the contention of ths Standard Oil company's n.ttornejTs that the Elkins law is repealed by the rate law, and that offenses can not be therefore punished under the former act, was contradicted by the United States district attorney, who declared that section 13 of the revised statutes covered the case in that it states that the repeal of an old statute does not condone prior offenses unless the repealing act so specifies in particular. W. S. CLAYTON A SUICIDE FOUND HANGING IN BARN. Deceased Was One of Best Known Men in Preble County Ohio and Was Recently Elected a Commissioner Wife Survives. - Eaton, O., Dec. 10, (Spl.) Appar. ently despondent because of the duties that would develope upon him when he should become a commissioner of Preble County, W. S. Clayton, aged about fifty years, yesterday morning, early went to the barn in the rear of his homo, just east of Eaton, and hanged himself with a rope to a cross beam. Mrs. Clayton had for some time observed Ihy husband's depression and was keeping close watch on him for fear he would take his life. When she awoke just before fiv'e o'clock and missed her husband she instituted a hurried search Jind discovered his body hanging lifeless at the barn. She set up an alarm and others soon appeared on the scene and the body was taken down. Mr. Clayton was one of the best known and most highly respected residents of Preble county, and his untimely death caused a profound shock. He leaves a wife and three children, Carl, of Chicago, Miss Alma Clayton, and Mrs. Henry C. Heistand both of Eaton. MILTON. Milton, Ind., (Dec. 10, fSpI.)
