ENTERED INTO BY JUDGE FOX OF WAYNE CIRCUIT COURT INTERNIEWED BY PAL. The Judge Thinks the Law is Weak and Should be Changed to Suit , Conditions. The divorce question has become the leading topic of conversation in this country and this is so because of the granting of so .many divorces by the eourts. A Palladium reporter called upon Judge Fox and asked in regard to the divorce situation, what the outcome would be if the present status of affairs continued. In reply to the interrogatory 'Judge Fox said: "The divorce question in this and other communities of this state is becoming a social and domestic problem that should receive the earnest consideration of all good citizens. There appears upon the docket of the Wayne Circuit Court for the April Term, fifty-seven divorce cases. If the ratio of increase in suits of this kind will in the future be as it has been in the last ten years, the ques tion may well be asked: "What will the harvest bef " Courts are pow erless in the premises for they cannot prevent the bringing of suits and when they are brought they must of necessity try them and administer the law as it is, for such is their sworn duty. A judge may question the propriety of the law and may criticise it but when required, he must execute it according to its terms regardless of results. The remedy lies with the law-making power. That there should be a radical change in our divorce statutes admits of no question and this the people of the state should seek to accomplish by all the means in their power. In my judgment it would be better if all divorces were denied rather than the condition should be as it now is; but this would be unfortunate, for injustice always results from extremes. "As the law now stands in this state, a person who ha been a resi dent of the state for two years and a resident of the county in which the suit is brought for a period of six months mav bring an action for di vorce. This should be changed so that a bona fide resident for three years next before the action - is brought in the county where brought, should be, required, such residence to be proved by two disinterested freeholders of the county. This in a great measure would prevent persons coming into the state for the sole purpose of procuring divorces, as is now often done. " Again, in my judgment, the law should be that when an action for divorce is brought and the defendant brought into court, a preliminary hearing should be had in which the court should make such orders concerning the property of the parties and the care, custody and support of children as would be just and equitable under the circumstances. The case should then be postponed and continued upon the docket for one year without further action; this would prevent hasty divorces and give the parties time for reflection and would in many instances result in reconciliation. If at the end of one year the parties are not reconciled, the case should be tried upon its merits. If upon the hearing the court is of the opinion that a divorce should be granted, a decree should be rendered granting a limited divorce for the period of three veal's at the expiration of which time the divorce should be come absolute without further litiga tion. At the time the decree is ren dered the court should give such judgment for alimony and for the care, custody and support of children as the evidence would warrant. Subject to the terms of the decree, each of the parties during the three-year limit should have the right to control and dispose of their separate property as they pleased without the assent of the other. If the parties should marry during that time for which the limited divorce is granted, such marriage should be declared null and void and the offending party should be subject to prosecution as if for bigamy. This would have a tendency to check the bringing of divorce suits by persons for the purpose of enabling them to remarry, as is often done. "I am not enamored with the theory that permanent limited divorces should be granted for experience has
proved that such divorces simply invite infidelity and dishonor. Human nature may be restrained but never changed. "In the majority of divorce suits under our present practice the judge is handicapped by reason of the fact that he only hears one side of the case the defendant being absent, and this often by agreement. When both parties are brought before the "court and
required to testify as witnesses, the facts as a rule are brought out so that the judge can act understanding'. In my judgment, the law should be that in all divorce trials where the defendant is not brought into court and examined as a witness, the plaintiff should be an incompetent witness. If this was the law, then both parties would be heard or neither. It should likewise be the law that a divorce in no case should be granted upon the uncorroborated testimony of a single witness but substantial corroboration upon all material points should be required. "If it was well understood that eourts would not grant a divorce save in a case of solid merit where all the facts were clearly proved, it would have a tendency to make peeople cautious when they enter the marital state and would cause greater effort to be made in order to reconcile differences that frequently arise between husband and wife. The marriage relation should be regarded as something more than a mere experiment. Marriage is the most important step that a man or woman can take in this life for it is the bedrock, the foundation of domestic and social happiness. From the relation of husband and wife springs the relation of parent and child and these two relations divinely created, overshadow all others that do or can exist. INDIANA'S GREAT DAY Immense Gathering Looked for at the World's Fair, September 1. Present indications point to a record-breaking day at St. Louis Thursday, September 1st, when the celebration of Indiana Day takes place at the World's Fair. The large number of Indiana people intending to be present at this great State function is shown by the advance requisitions for tickets to St. Louis the ensuing fortnight.
