INTERSTATE COMMISSION TO ENFORCE PENALTY
A PROTEST ENTERED
By Proctor & Gamble Claiming a Conspiracy Was Entered Into by . . Roads.
Cincinnati, July 22. One of the largest suits ever filed in this city was that entered "Wednesday in the United States Circuit Court by United States District Attorney Sherman T. McPherson, acting for the Interstate Commerce Commission, against the Cincinnati, Hamilton & Dayton railway company, the Pittsburg, Cincinnati, Chicago & St. Louis railway company, the Pennsylvania railroad company, the Cleveland, Cincinnati, Chicago & St. Louis railway company, the Lake Shore and Michhigan Southern railway company, the New York Central and Hudson river railroad company, the Baltimore & Ohio Southwestern company and the Baltimore & Ohio company. The eight roads are charged with continued violations of the Interstate Commerce Commission's ruling and orders issued more than a year ago. The petition asks that each road be enjoined from further violations, and be fined $500 for each day's violation. Penalty is asked for 371 days, or a total of $1,4S4,000 from the eight roads. This action is based upon a complaint of the Proctor & Gamble company, of Ivorydale, Ohio, alleging that the eight roads entered into a conspiracy to raise the classification on common or laundry soap. It is charged that it was raised from the sixth to the fifth class, shipped in carload lots, and in less quantities from the fourth to the third class. The complaint charges that the effect was to increase the rate of freight upon this article only, the increase not applying also to other articles in the same class. The Proctor & Gamble company asserts that the difference in freight rates to it under the present classification and the old one is more than $150 a day, and that this has been going on since January 1, 1900. The Interstate Commerce Commission ordered that the roads desist from further attempt to collect the higher rates for shipping soap, but it is alleged that no attention was paid to this order. Deafness Cannot Be Cured. by local applications, as they cannot reach the diseased portion of the ear. There is only one way to cure deafness, and that is by constitutional remedies. Deafness is caused by an inflamed condition of the mucous lining of the Eustachian Tube. When this tube is inflamed you have a rumbling sound of imperfect hearing and wen it is entirely closed, deafness is the result, and unless the inflammation can be taken out and this tube restored to its normal condition, hearing will be destroyed forever; nine cases out of ten are caused by eatarrh, which is nothing but an inflamed condition of the mucous surfaces. We will give one hundred dollars for any case of deafness (caused by
catarrh) that cannot be cured by
