Gloomy plays, except in rare instances, are not favorably received. Audiences', especially women audiences, like to have their feelincrs wrought upon to a certain extent ; they even enjoy an opportunity to shed a few tears. But they also like to have the tears followed by laughter, they want the sun to come out between the clouds. Since "East Lynne," there has probably not been a play produced which draws women to witness it in such crowds as does Lottie Blair Parker's drama of love among the blossoms, "Under Southern Skies." There is something about the beautiful stage settings, youthful, summery dresses, crowds of gay young folks, Halloween tricks. Jack-o-lantern dance and touching love scenes that enchant the young, who ai-e in the hey-day of tlieir own pleasures, and fascinate their elders by carrying them back to their own merry days sometimes so long past or so overgrown with world ly cares and worries that they have been . forgotten until suddenly brought to vivid remembrance by the life-like scenes of "Under Southern Skies." All women love the play, and men enjoy it, so it is not strange that it is now in its third season, playing to larger audiences than ever before, the capacity of the theatre being tested in every city fortunate enough to secure this remarkably successful drama. "Under Southern Skies" is to appear in "Richmond at the Gennett theatre on Monday evening next and the indications are that it will ge witnessed by a large and fashionable audience. THE SUPREME COURT ON NEGRO DISFRANCHISEMENT. (Chicago Reeord-IIerald.) For th second time the United States supreme court has refused relief to Jackson W. Giles, an Alabama negro who has been disfranchised under the operation of the new Alabama state constitution. Last spring the court decided that Giles could secure no help tli roti irh equity proceedings begun in the federal circuit courts. Now it decides against him on a writ of error from the state supreme court of Alabama, where Giles had sought to mandamus the local election officials to register him as a voter. Justice Ifarlan alone is named as dissenliiig from this second decision. The argument upon which the court's opinion is based is that no
federal question is involved in the case, in the form in which it is brought up for decision. The language used is as follows: "Now it is perfectly settled that unless federal right has been set up and denied in the state court we have no right to review its decision, and after a very careful examination of this matter, and a due appreciation of the gravity of the eharge made as to the political action of the state, we see no ground to distinguish from the universal rule as applied in this court affecting writs of error of this kind." It will be remembered that the Alabama constitution provided for a permanent registration list to be prepared prior to January 1, 1903, upon which list were to be entered the names of all citizens of the state who were (1) soldiers in Avars of the United States, (2) descendants of revolutionary soldiers, or (3) "persons of good character who understand the duties and obligations of citizenship under a republican form of government." After the date named educational and property qualifications were required of all applicants for registration. The practical effect has been to give Alabama a registration list containing the names of 190,000 persons, of whom only 2,9S0 are colored. The state has in, round numbers 1,000,000 white inhabitants and S00,000 negroes. The whites feel so perfectly secure in their control of the state that 47,000 of them have already forfeited temporarily at least, their right to vote, through non-payment of the .1.50 poll tax. If the present supreme court decision, settles conclusively the fact that negroes can secure no relief from these conditions through the federal courts, a fresh agitation may soon be expected for action by congress to reduce the representation of the southern states in the House of Representatives proportionately to the extent of their disfranchisement of the eolored voters.
