mm. When D. K. Zeller died he left a will in which he placed $5,000 of his estate in the hands of his son and daughter as trustees for benevolent uses in such a way that the mom y was to be loaned at 6 per cent, and the interest for ten years to go to the Presbyterian church of which be was a member; and after that time the 5,000 to go in other benevolences. The will was made several years ago when it was easy to get 6 per cent, out of money on loan. Now the tax rate is such as to amount to nearly 3i per cent., which would cut the net amount to go to the church considerably. Mr. Compton. the assessor, gives the opinion that it is taxable and will be listed for taxation. If left direct to the church it would have been exempt, but so long as it is in the hands of trustees it must pay taxes.
