decision, in the case of Elbert H. Bhirk against the city of Loganaport on appeal from White county, where the case was triad on change ot venue. It relates to

"The controversy arose aa to the title to that part of the canal bed known aa Fifth street, the plaintiff claiming to own it by virtue of a decree and sale of the United States court upon a foreclosure

against the old trustees ol tne waoaan and Erie canal, and the city contending that the canal company never had tha fee simple title to the street, but only a license to use it as a canal, and that upon abandonment for canal purposes it reverted to its former uses as a street. THE INSANE iSTLIin QOESIIOJU The insane asylum commissioners, with the governor as ex officio head, are still wrestling with the question of locations for the two asylums unprovided for, and also a site for the Evansville institution. The following, from the Indianapolis Journal, shows the drift of the controversy: "The insane hospital commissioners, after an all-day session yesterday without reaching any determination, decided to adjourn, and although no time has been definitely fixed, it is understood that they will meet again in about two weeks. The commissioners each have their own ideas about the most eligible sites for the location of the hospitals, and no agreement could be reached. The inducements which hsve been offered in the way of donations of land were not expected by the commissioners, and they feel that it ia their duty to give them consideration. It is altogether likely that the location of the institutions will be made, the advantages of site being about equal, where the largest donations of land are offered." The Evansville papers state that the commission is expected to visit that place
