After the prisoners were brought into court it was decided upon the part of the state to accept a plea of guilty upon the part of GofF and Phillips to the crime of petit lar ceny, it being thought by lire pros ecuting niton.ey that that would he the grade id crime which ili<evidence would estnblisb. Barkley, who stood charged wit), the same crime as the others, ami in whose case the evidence would be the same, concluded not to plead guilty, blit to stand ti.e cbaiices of a '.i I i before a jury.
