For i*ua>ous best known to the Hev. gentleman he omitted tho word “regenerate.’ ’ For this neg-; Icelpofaplaint was made to tho Hish- j op of that Diocea.se, who proceeded to convene an ccleeinslicid court, j consisting of live Episcopal ministers, which preceded to try tlie relractpry brother lor his finsof omission. The arraigned protests the jurisdiction of the court claiming that they had all expressed opinions ol guili and had been irregnlarly con- i veiled inasmuch as the' church can- | ons provided that eight clergymen l»c in attendance from which the accused is t-o select the live. Jlis objections and protest were overruled, whereupon lie gives notice that he has applied to the Superior Court, of Chicago, for nn fitiunetion against all farther proceedings bv the cch-siastiq.al court and that tlie writ had been granted.— The Sheriff of Cook county tlicrcapon served ujkui tlie five clergymen sitting ns ft court, the injunction. After of the writ tlie clergymen adjourned unuLnextday, and -then adjourned until last Friday. We look-at this as one of themost remarkable cases ever brought bclore the American civil courts. It involves the religious rights of the people*, and particularly tlie rights,: privileges and powers ol' religious communities, and their governmental authority over their members. It’ the civil courts can lake cognizance of cclesiasticnl courts in the United States and inquire wlwthcr their proceeding nro in accordance with, their denominational canons, and then by ft writ ot mandamus can compel the cclesiastical court to proceed in a manner it believes to be contrary to their church laws —it the civil courts have this power, they have also power to decide whether th* - facts. adduced are .sufficient to justify the findings, and if not then to set the findings aside.
Let it be established that tbe civil courts have power to interfere with ebureh maltera aud tliey will be ayjteaied t-> Iti every petty grievtintS? brought before tbe church for canonical adjudication!, for in nearly every instance where parties are expelled, or ministers relieved ot their pastorates, they believe they have just grounds of complaint in a civil action, against the brethren instrumental in their expulsion or removal. As a general rule, these church squabbles are disagreeable enough to be permitted to die out in the church, but if tliey may lie taken into the civil courts their bitterness will be more titan doubled. We trust that for the peace of society the Chicago court^will dissolve its injunction against the oclcsiastieal court and permit it to decide purely church affairs as to them shnll seem proper in tho premises.
